【摘要】：現(xiàn)在人們普遍認(rèn)為商法產(chǎn)生于中世紀(jì)商人法,羅馬法中無商法。該觀點(diǎn)源自對商法范疇在歷史語境下具體分析的闕如,其論據(jù)主要為羅馬法律詞匯中沒有表示商法部門及區(qū)別于一般私法制度的概念和術(shù)語。通過分析原始文獻(xiàn)可以發(fā)現(xiàn)這些論據(jù)是不成立的。裁判官為了因應(yīng)羅馬國家的擴(kuò)張,在告示和相關(guān)司法活動(dòng)中創(chuàng)造出一系列專門規(guī)制此等特殊法律關(guān)系的規(guī)范,昭示了實(shí)質(zhì)意義上的商法的誕生,銀行法為其重要組成部分。銀行業(yè)活動(dòng)在公元前4世紀(jì)便已在羅馬出現(xiàn),在商業(yè)化時(shí)代獲得重大發(fā)展。為規(guī)范這些具有特殊性的活動(dòng),羅馬法學(xué)在司法管轄、組織機(jī)構(gòu)、賬簿出示、抵銷等具體制度中回應(yīng)了實(shí)踐的要求。在從商業(yè)化時(shí)代向優(yōu)士丁尼時(shí)期的轉(zhuǎn)變過程中,銀行業(yè)經(jīng)歷了衰落與復(fù)興,并在相關(guān)法律規(guī)范中映射了這一過程。
[Abstract]:Now it is generally believed that commercial law originated in medieval merchant law, and there is no commercial law in Roman law.This view originates from the lack of concrete analysis of the category of commercial law in the historical context. The main argument is that there are no concepts and terms in the Roman legal vocabulary which indicate the commercial law department and are different from the general private law system.By analyzing the original literature, we can find that these arguments are untenable.In order to cope with the expansion of the Roman country, the magistrate created a series of special regulations to regulate these special legal relations in notices and related judicial activities, which showed the birth of the commercial law in the substantive sense, and the banking law was an important part of it.Banking began in Rome in the 4 th century BC and developed significantly in the commercial age.In order to regulate these special activities, Roman jurisprudence responded to the practical requirements in the specific systems of jurisdiction, organization, account book production, offset and so on.During the transition from commercial era to Yosdini period, the banking industry experienced decline and revival, and reflected this process in the relevant legal norms.
