【摘要】： 我國(guó)《海商法》對(duì)保險(xiǎn)利益的概念、轉(zhuǎn)讓、確定及其對(duì)保險(xiǎn)合同效力的影響方面,均未做出規(guī)定,但《保險(xiǎn)法》關(guān)于保險(xiǎn)利益的規(guī)定明顯和海上保險(xiǎn)中的保險(xiǎn)利益原則不符。我國(guó)《保險(xiǎn)法》在傳統(tǒng)上被認(rèn)為是大陸法的繼受,但是《海商法》又深受英美法實(shí)證法律價(jià)值觀的影響,此種特性在《海商法》保險(xiǎn)利益原則上表現(xiàn)的非常突出。在司法實(shí)踐中往往導(dǎo)致出現(xiàn)大陸法系的概念和術(shù)語(yǔ)解釋英美法的現(xiàn)象,使得海上保險(xiǎn)在適用保險(xiǎn)利益原則時(shí)產(chǎn)生諸多法律問(wèn)題。本文以海上保險(xiǎn)中的保險(xiǎn)利益原則為研究對(duì)象,首先闡述保險(xiǎn)利益的基本情況,其次對(duì)海運(yùn)貨物的保險(xiǎn)利益和船舶的保險(xiǎn)利益問(wèn)題進(jìn)行研究,第三部分提議在我國(guó)海上保險(xiǎn)中應(yīng)該采用經(jīng)濟(jì)利益原則,最后對(duì)我國(guó)海上保險(xiǎn)立法做出若干建議。
[Abstract]:The maritime law of our country has not stipulated the concept, assignment, determination and effect on the validity of insurance contract of insurance interest. However, the provisions of the Insurance Law on insurance interests are obviously inconsistent with the principle of insurance interests in marine insurance. China's Insurance Law has traditionally been regarded as a successor to continental law. However, the Maritime Law is deeply influenced by the values of the empirical law of the United States and the United States. This characteristic is very prominent in the principle of "Maritime Law" insurance interest. In judicial practice, it often leads to the phenomenon of the concept and terminology of civil law system explaining Anglo-American law. This paper takes the principle of insurance interest in marine insurance as the research object, first of all, it expounds the basic situation of insurance interest. The third part proposes to adopt the economic benefit principle in our country's marine insurance, and finally makes some suggestions to our country's marine insurance legislation.
