【摘要】：本文以海上保險(xiǎn)代位求償權(quán)這一保險(xiǎn)理論中的熱點(diǎn)問(wèn)題作為研究對(duì)象。 代位權(quán)有狹義與廣義之分，狹義的代位權(quán)僅指代位求償權(quán)(權(quán)利上的代位)，廣義的代位權(quán)不僅包括權(quán)利上的代位還包括物上代位權(quán)。本文作者從狹義的角度出發(fā)，以民法和保險(xiǎn)法的理論為基礎(chǔ)，第一章分別對(duì)海上保險(xiǎn)代位求償權(quán)的概念、理論基礎(chǔ)、功能、性質(zhì)及其獨(dú)特性作了詳盡的論述。代位求償權(quán)源于民法上的債權(quán)讓與制度，性質(zhì)上屬于法定的債權(quán)讓與，與不真正連帶債務(wù)理論有較相似之處。代位求償權(quán)是保險(xiǎn)合同補(bǔ)償性，維護(hù)保險(xiǎn)人利益為目的，是法律公平的體現(xiàn)。但與民法上的代位有明顯的本質(zhì)上的區(qū)別。海上保險(xiǎn)中的代位求償權(quán)還具有其海上活動(dòng)中存在著航行過(guò)失免責(zé)制度及賠償責(zé)任限制這一獨(dú)特性。 第二章在剖析海上保險(xiǎn)代位求償權(quán)概念及性質(zhì)的基礎(chǔ)上，筆者詳細(xì)地分析了海上保險(xiǎn)代位求償權(quán)的成立條件、行使條件、行使方式以及海上保險(xiǎn)代位求償權(quán)的效力等問(wèn)題。在本章中，筆者主張代位求償權(quán)的成立應(yīng)以保險(xiǎn)合同的有效成立為首要條件。從五方面論述其行使應(yīng)具備的條件，，并在代位求償?shù)男惺姑x問(wèn)題上，筆者始終堅(jiān)持保險(xiǎn)人應(yīng)以自己的名義行使或通過(guò)申請(qǐng)變更為自己的名義行使其權(quán)利。即嚴(yán)格按照《海事訴訟特別程序法》的規(guī)定行使，維護(hù)了保險(xiǎn)人的利益。 第三章初步探討了海上保險(xiǎn)代位求償權(quán)所涉及的訴訟問(wèn)題：訴訟主體、訴訟標(biāo)的、訴訟時(shí)效三方面的問(wèn)題。在訴訟時(shí)效問(wèn)題上，筆者主張比照我國(guó)《海商法》第257條加強(qiáng)對(duì)保險(xiǎn)人代位求償權(quán)的保護(hù)。本人試圖對(duì)海上保險(xiǎn)代位求償權(quán)做一個(gè)比較系統(tǒng)全面地論述，希望對(duì)從事保險(xiǎn)業(yè)務(wù)的有關(guān)人員有所幫助，能起到一個(gè)拋磚引玉之效。
[Abstract]:This paper focuses on subrogation of marine insurance, which is a hot issue in insurance theory. The right of subrogation is divided into narrow sense and broad sense. In narrow sense, subrogation only refers to subrogation right (right subrogation right, broad subrogation right includes not only subrogation on right but also subrogation on substance. Based on the theory of civil law and insurance law, the first chapter discusses in detail the concept, theoretical basis, function, nature and uniqueness of subrogation right of marine insurance. In nature, it belongs to the legal assignment of creditor's rights, which is similar to the theory of unreal joint and several debts. The subrogation right is the compensatory nature of insurance contract, and the purpose is to safeguard the interests of the insurer. The subrogation in marine insurance also has the uniqueness of the exemption system of navigational negligence and limitation of liability in marine activities. In the second chapter, on the basis of analyzing the concept and nature of marine insurance subrogation, the author analyzes in detail the conditions for the establishment and exercise of marine insurance subrogation. In this chapter, the author argues that the establishment of subrogation should be based on the effective establishment of insurance contract. On the issue of the name of subrogation, the author always insists that the insurer should exercise its rights in its own name or by applying for change to its own name, that is, it should be exercised strictly in accordance with the provisions of the Special procedure Law of Maritime Proceedings. The interests of the insurer were safeguarded. The third chapter discusses the litigation issues involved in the subrogation of marine insurance: the subject of action, the subject of action and the limitation of action. The author advocates to strengthen the protection of the insurer's subrogation right according to Article 257 of the Maritime Law of China. I try to make a systematic and comprehensive discussion on the subrogation right of marine insurance, hoping to be helpful to the relevant personnel engaged in insurance business. Can play a brick to attract jade effect.
