【摘要】:隨著世界貿(mào)易和科技的不斷發(fā)展,危險(xiǎn)品涉及的領(lǐng)域不斷增多,在各個國家的經(jīng)濟(jì)發(fā)展、科學(xué)研究以及貿(mào)易往來中均有危險(xiǎn)品的存在。作為海上運(yùn)輸領(lǐng)域的一個重要組成部分,危險(xiǎn)貨物運(yùn)輸?shù)奶厥庑栽诤竭\(yùn)界和海商法理論界一直倍受關(guān)注。承運(yùn)人不僅要運(yùn)送無危險(xiǎn)的貨物,還要運(yùn)輸有風(fēng)險(xiǎn)的貨物,托運(yùn)人既要承擔(dān)貨物毀損的結(jié)果,還要承擔(dān)對承運(yùn)人或第三方造成的人身傷亡、貨物毀損的責(zé)任。在什么情況下由誰承擔(dān)什么樣的責(zé)任,承擔(dān)多少,在我國《海商法》中規(guī)定的略顯單薄。因此,承托雙方法律責(zé)任的劃界問題更是成為一直以來的研究熱點(diǎn)。 本文從海上危險(xiǎn)貨物運(yùn)輸中有關(guān)承托雙方法律責(zé)任的相關(guān)立法入手,通過理論分析、比較分析、實(shí)證分析和圖表分析等方法將研究的總體框架置于危險(xiǎn)貨物承托雙方責(zé)任劃分的理論與實(shí)踐分析中,進(jìn)而明確托運(yùn)人和承運(yùn)人在危險(xiǎn)貨物運(yùn)輸中的法律地位以及特殊權(quán)利、義務(wù);研究危貨托運(yùn)人、承運(yùn)人責(zé)任承擔(dān)的理論基礎(chǔ),同時(shí)借鑒航運(yùn)發(fā)達(dá)國家的權(quán)威判例得出說服力極強(qiáng)的歸責(zé)原則;并根據(jù)相關(guān)義務(wù)劃分責(zé)任承擔(dān)的具體內(nèi)容,最后結(jié)合了有關(guān)危險(xiǎn)貨物運(yùn)輸?shù)膰H公約、世界各地和地區(qū)有關(guān)海上貨物運(yùn)輸?shù)南嚓P(guān)立法,將提出的比較全面的有關(guān)危險(xiǎn)貨物承托雙方責(zé)任的具體內(nèi)容,形成于法律條文的修改中去。 本文希望通過對危險(xiǎn)貨物承托雙方權(quán)利義務(wù)以及責(zé)任的全面梳理,進(jìn)一步明確危險(xiǎn)貨物承托雙方的責(zé)任劃界問題,對各自應(yīng)該承擔(dān)的責(zé)任作出詳細(xì)規(guī)定,形成于具有明確性和可操作性的法律條文,使責(zé)任的承擔(dān)更趨于合理化,以保障海上危險(xiǎn)貨物運(yùn)輸安全,促進(jìn)海上危險(xiǎn)貨物運(yùn)輸?shù)慕】蛋l(fā)展。
[Abstract]:With the continuous development of world trade and science and technology, dangerous goods are involved in more and more fields. There are dangerous goods in the economic development, scientific research and trade of all countries. As an important part of the field of maritime transport, The particularity of the transport of dangerous goods has been paid much attention to by the shipping and maritime law theorists. The carrier not only carries the goods without danger, but also carries the goods at risk, and the shipper should bear the result of the damage of the goods. Also bear the responsibility of personal injury or injury to the carrier or a third party, damage to the goods. Under what circumstances, who will bear what kind of responsibility, how much, in our country "maritime law" stipulated a little thin. Therefore, The delimitation of legal liability between the two parties has been a hot research topic all the time. This paper begins with the relevant legislation on the legal liability of both parties involved in the carriage of dangerous goods by sea, through theoretical analysis, comparative analysis, The methods of empirical analysis and chart analysis put the overall framework of the study in the theoretical and practical analysis of the division of the liability of the parties to the dangerous goods, and then clarify the legal status and special rights of the shipper and the carrier in the transport of dangerous goods. Obligations; studying the theoretical basis of carrier's liability, and drawing lessons from the authoritative jurisprudence of developed countries to draw a persuasive imputation principle; and dividing the specific content of liability according to the relevant obligations, Finally, combining the international conventions on the transport of dangerous goods and the relevant legislation on the carriage of goods by sea in various parts of the world and regions, it will put forward more comprehensive and specific contents concerning the liability of both parties to the transport of dangerous goods. Formed by the amendment of the law. This paper hopes that through a comprehensive review of the rights, obligations and responsibilities of both parties to the transport of dangerous goods, it will further clarify the delimitation of the responsibilities of both parties, and make detailed provisions on their respective responsibilities. It is formed by the clear and operable legal provisions, which makes the responsibility more reasonable, in order to ensure the safety of the transport of dangerous goods by sea and promote the healthy development of the transport of dangerous goods by sea.
