國際海上貨物運輸合同收貨人相關法律問題研究

【摘要】:在海上貨物運輸合同中,收貨人具有特殊的法律地位。相關的國際公約、我 國海商法及大多數的提單內容和條款卻對收貨人的法律規(guī)定、約定不清晰、不系 統(tǒng)、不完整。本文嘗試對收貨人的涵義、收貨人與提單持有人的關系、收貨人對 承運人權利義務的法理依據、收貨人權利義務的系統(tǒng)歸納、收貨人對承運人的訴 權等問題進行研究,并指出相關的國際公約和我國海商法應完善對收貨人的立法, 以更好的保護收貨人的合法權益,減少理論的爭論和司法實踐的混亂。 在對上述問題研究的基礎上,本文也嘗試對我國海商法有關收貨人的立法提 出相關的修改建議,以供參考。 我國海商法有關收貨人的概念是廣義收貨人的概念,原則上,這沒有問題, 但在有關特別保護狹義收貨人利益的條款中,應將托運人作為收貨人的情況排除 在外,具體體現在海商法第78條的修改意見中;為明確收貨人與提單持有人的關 系,本文主張應規(guī)定提單持有人的法律概念,以減少理論的爭論和統(tǒng)一實踐中的 作法;本文認為,有關收貨人對承運人的權利、義務來源于法律的明確規(guī)定,因 此,我國海商法應增加有關收貨人對承運人的提貨請求權、訴權的明確規(guī)定,并 增加有關貨物控制權的法律規(guī)定,以完善我國海商法有關收貨人的法律規(guī)定。
[Abstract]:In a contract for the carriage of goods by sea, the consignee has a special legal status. China's maritime law and most of the contents and terms of bills of lading are unclear as to the legal provisions of the consignee. The meaning of consignee, the relation between consignee and holder of bill of lading, the relation between consignee and holder of bill of lading, the relation between consignee and holder of bill of lading, The legal basis of the carrier's rights and obligations, the systematic summary of the consignee's rights and obligations, and the consignee's action against the carrier. And pointed out that the relevant international conventions and China's maritime law should improve the legislation on the consignee, In order to better protect the legal rights and interests of the consignee, reduce the theoretical debate and judicial practice confusion. On the basis of the study of the above problems, this paper also tries to propose the legislation of the consignee in China's maritime law. Give relevant suggestions for modification for reference. The concept of consignee in China's maritime law is the concept of a broad sense of consignee. In principle, this is no problem. However, in the article on special protection of the narrow interests of the consignee, the circumstances in which the shipper is the consignee should be excluded. Outside, as reflected in the amendment of article 78 of the maritime law; in order to clarify the relationship between the consignee and the holder of the bill of lading. This article argues that the legal concept of the holder of a bill of lading should be defined in order to reduce the theoretical debate and unify the practice of. In this paper, it is argued that the obligations of the consignee with regard to the carrier are derived from the explicit provisions of the law. Therefore, the maritime law of our country should increase the clear provisions of the consignee's right of claim and right of action against the carrier, and. In order to perfect the legal provisions of the consignee in China's maritime law, the legal provisions on the right of control of the goods are added.
