【摘要】：自上個世紀(jì)以來,在國際海事委員會、國際海事組織、聯(lián)合國貿(mào)易發(fā)展委員會以及聯(lián)合國貿(mào)易法律委員會等國際組織的努力下,制定了幾十個國際海事公約,這些國際海事公約對促進(jìn)國際貿(mào)易的發(fā)展和規(guī)范國際海運(yùn)市場起到了重要的作用。同時,也對各國的海商法產(chǎn)生了重要的影響。 本文首先對國際海事立法的歷史發(fā)展和立法現(xiàn)狀進(jìn)行了分析,在此基礎(chǔ)上,概述了進(jìn)入21 世紀(jì)以后國際海事立法的新發(fā)展。這些新發(fā)展具體體現(xiàn)在四個方面,即海上貨物運(yùn)輸法律的統(tǒng)一方面、船舶油污立法方面、國際海上旅客運(yùn)輸法律的修改方面和國際海運(yùn)反恐立法方面。進(jìn)而又對我國海商法的立法特點和實施現(xiàn)狀進(jìn)行了論述。我國海商法立法的最大特點就是與當(dāng)時的國際海事立法相接軌,那么,在對我國海商法進(jìn)行修改和完善之時,仍然要遵循這一立法特點。因此,在本文的最后,筆者著重論述了上述四個方面國際海事立法新發(fā)展對我國海商法的影響以及我國海商法的應(yīng)對措施。
[Abstract]:Since the last century, dozens of international maritime conventions have been developed through the efforts of international organizations such as the International Maritime Committee, the International Maritime Organization, the United Nations Trade Development Commission and the United Nations Trade Law Commission. These international maritime conventions play an important role in promoting the development of international trade and standardizing the international maritime market, and also have an important impact on the maritime law of various countries. Based on the analysis of the historical development and current situation of international maritime legislation, this paper summarizes the new development of international maritime legislation after entering the 21st century. These new developments are embodied in four aspects. That is, the unification of the law on the carriage of goods by sea, the legislation on the oil pollution of ships, In this paper, the legislative characteristics and implementation status of China's maritime law on maritime transport of passengers are discussed. The greatest characteristic of the legislation of maritime law of our country is the same as that of that time. In line with international maritime legislation, So, when we revise and perfect the maritime law of our country, we should still follow this legislative characteristic. Therefore, at the end of this paper, The author emphatically discusses the influence of the new development of the international maritime legislation on the maritime law of our country and the countermeasures of the maritime law of our country.
