法定船舶抵押權(quán)若干問題初探

【摘要】: 法定船舶抵押權(quán)是海商法領(lǐng)域比較有特色的制度之一,這項古老的制度對于促進世界航運業(yè)的發(fā)展具有非常重要的意義,因此研究這一制度對于更好的學(xué)習(xí)海商法的相關(guān)理論知識意義深遠(yuǎn)。 眾所周知,船舶主要是為國際貿(mào)易服務(wù)的,這就使得海商法具有極強的涉外性和國際性。由于各國立法存在差異,適用不同的法律產(chǎn)生的判決結(jié)果差別很大。為促進國際航運的發(fā)展,國際社會自19世紀(jì)以來就致力于法定船舶抵押權(quán)的統(tǒng)一問題,并陸續(xù)通過了1926年公約、1967年公約和1993年公約。由于我國《海商法》頒布較晚,關(guān)于法定船舶抵押權(quán)的理論研究還不成熟,在實踐中經(jīng)常出現(xiàn)歧義,為司法上的統(tǒng)一也帶來了困難。歸根結(jié)底,出現(xiàn)這些問題的原因在于我國學(xué)術(shù)界和司法界對英美法中的制度“Lien”存在誤解,導(dǎo)致對法定船舶抵押權(quán)——Maritime Lien的理解存在偏差。 本文選擇法定船舶抵押權(quán)為研究對象,以我國《海商法》為基礎(chǔ),結(jié)合國際公約和主要海運國家的有關(guān)法律,用比較法學(xué)的研究方法,力求追本溯源,從對“Lien”的探討來糾正海商法領(lǐng)域所謂船舶優(yōu)先權(quán)的稱謂,從而從一個全新的視角來搞清法定船舶抵押權(quán)的性質(zhì),在認(rèn)清法定船舶抵押權(quán)的性質(zhì)的基礎(chǔ)上,對相關(guān)的內(nèi)容進行研究。本文第一章首先通過比較分析對法定船舶抵押權(quán)進行了正名,指出傳統(tǒng)的“船舶優(yōu)先權(quán)”的稱謂存在的問題,通過對其正名進一步明確了法定船舶抵押權(quán)擔(dān)保物權(quán)的法律性質(zhì)。第二章利用比較分析的方法對法定船舶抵押權(quán)所擔(dān)保的債權(quán)項目進行了分析,并通過國際公約的規(guī)定和各國法律的規(guī)定指出了債權(quán)項目的發(fā)展趨勢。第三章著重探討了法定船舶抵押權(quán)所擔(dān)保的債權(quán)項目的優(yōu)先順位問題,在這部分糾正了優(yōu)先權(quán)項目這一說法,對債權(quán)項目的優(yōu)先順位從理論上進行了探討;當(dāng)法定船舶抵押權(quán)與其它擔(dān)保物權(quán)發(fā)生競合時,對何者優(yōu)先實現(xiàn)的問題也進行了闡述;為彌補法定船舶抵押權(quán)存在的不足,建議設(shè)立法定船舶抵押權(quán)信息批露制度。第四章比較了大陸法系和英美法系中,,法定船舶抵押權(quán)行使的程序問題,并對法定船舶抵押權(quán)的消滅提出了自己的一些看法。
[Abstract]:Legal ship mortgage is one of the characteristic systems in the field of maritime law. This ancient system is of great significance to promote the development of the world shipping industry. Therefore, the study of this system for a better study of maritime law related theoretical knowledge far-reaching significance. As we all know, ships mainly serve for international trade, which makes maritime law very foreign and international. In order to promote the development of international shipping, the international community has been working since 19th century on the unification of legal mortgage of ships. The Convention of 1926, the Convention of 1967 and the Convention of 1993 have been adopted one after another. Due to the late promulgation of Maritime Law in China, the theoretical research on the legal mortgage of ships is still immature, and there are often ambiguities in practice. In the final analysis, the causes of these problems lie in the misunderstanding of the institution "Lien" in Anglo-American law, which leads to the misunderstanding of the legal mortgage of maritime Lien. This article chooses the legal ship mortgage as the research object, takes our country's Maritime Law as the foundation, unifies the international convention and the main shipping country's related law, uses the comparative law research method, strives to trace back to the source, From the discussion of "Lien" to correct the title of maritime lien in the field of maritime law, so as to find out the nature of legal ship mortgage from a new angle of view, and on the basis of recognizing the nature of legal ship mortgage, In the first chapter of this paper, by comparing and analyzing the title of legal ship mortgage, the author points out the problems existing in the traditional title of "maritime lien". The legal nature of the security right of legal ship mortgage is further clarified through the correction of its name. Chapter two analyzes the items of creditor's rights secured by legal ship mortgage by using the method of comparative analysis. Through the provisions of international conventions and the provisions of national laws, the development trend of creditor's rights projects is pointed out. Chapter three focuses on the priority of creditor's rights guaranteed by legal mortgage of ships. In this part, the claim of priority item is corrected, the priority of creditor's right item is discussed theoretically, when the legal mortgage of ship is competing with other security right, the problem of which priority is realized is also expounded. In order to make up for the deficiency of the legal ship mortgage, it is suggested to establish the disclosure system of the legal ship mortgage. Chapter 4th compares the procedural problems in the exercise of the statutory ship mortgage between the civil law system and the Anglo-American law system. At the same time, it puts forward some views on the elimination of legal ship mortgage.
