【摘要】： 近十幾年來,與國際互聯(lián)網(wǎng)相伴而生的電子商務(wù)作為一種革命性的貿(mào)易方式在國際貿(mào)易中得到廣泛應(yīng)用。它對(duì)國際貿(mào)易產(chǎn)生的深遠(yuǎn)影響有目共睹、毋庸置疑,且已有大量文章對(duì)此進(jìn)行了深入的經(jīng)濟(jì)學(xué)討論。在這些討論中,電子商務(wù)的經(jīng)濟(jì)意義通常被歸納為:增加貿(mào)易機(jī)會(huì)、降低貿(mào)易成本、提高貿(mào)易效益。 現(xiàn)代社會(huì)的經(jīng)濟(jì)總是受到法律的規(guī)整,而經(jīng)濟(jì)的發(fā)展也反過來影響法律的變革。應(yīng)該注意到,電子商務(wù)在國際貿(mào)易中的應(yīng)用不僅沖擊著世界經(jīng)濟(jì)的運(yùn)行也沖擊著固有的法律觀念。與此同時(shí),國際經(jīng)貿(mào)法律為解決電子商務(wù)帶來的嶄新法律問題,也做出了一些主動(dòng)的或被動(dòng)的突破性調(diào)整。 本文試從國際經(jīng)貿(mào)法律的視角,研究電子商務(wù)如何在保護(hù)主義卷土重來的貿(mào)易環(huán)境里繼續(xù)推動(dòng)了國際貿(mào)易向自由化發(fā)展,并探討未來網(wǎng)絡(luò)經(jīng)濟(jì)中基于電子商務(wù)模式以及網(wǎng)絡(luò)自治制度的全球貿(mào)易自由化的前景。 為此,本文將從電子商務(wù)區(qū)別于傳統(tǒng)貿(mào)易的特征出發(fā),討論電子商務(wù)的法律意義,分析電子商務(wù)與國際經(jīng)貿(mào)法律之間的互作用,并進(jìn)一步探討該互作用對(duì)國際貿(mào)易自由化的影響,從而證明:自由貿(mào)易的根本阻力來自地區(qū)經(jīng)濟(jì);而電子商務(wù)與生俱來的特質(zhì)可謂是“反”地區(qū)經(jīng)濟(jì)的,電子商務(wù)要求并加速“國界”的瓦解,它通過打破地區(qū)經(jīng)濟(jì)、動(dòng)搖國家管制、沖擊建立在地域基礎(chǔ)上的傳統(tǒng)法律制度、促進(jìn)國際商法統(tǒng)一……等等,極大地推進(jìn)了國際貿(mào)易自由化;另一方面,傳統(tǒng)法律在試圖將電子商務(wù)納入其管制的同時(shí),卻受電子商務(wù)自由化特性的影響而趨向自由化方向轉(zhuǎn)變。在此結(jié)論的基礎(chǔ)上,本文進(jìn)而展望:在信息經(jīng)濟(jì)全球化的趨勢(shì)下,在蓬勃發(fā)展的電子商務(wù)的要求下,國際經(jīng)貿(mào)法律如敢于大刀闊斧地深入變革,網(wǎng)絡(luò)自治——至少網(wǎng)絡(luò)經(jīng)濟(jì)自治將成為可能,同時(shí),理想的自由貿(mào)易將趨近現(xiàn)實(shí)。
[Abstract]:In the past ten years, electronic commerce, accompanied by the Internet, has been widely used in international trade as a revolutionary way of trade. In these discussions, the economic significance of electronic commerce is usually summed up as: increase trade opportunities, reduce trade costs, and improve trade efficiency. The economy of modern society is always regulated by law, and the development of economy in turn affects the change of law. The application of electronic commerce in international trade impacts not only the operation of the world economy but also the inherent legal concept. At the same time, the international economic and trade law brings new legal problems to solve the electronic commerce. Also made some active or passive breakthrough adjustment. From the perspective of international economic and trade law, this paper tries to study how electronic commerce continues to promote the development of international trade towards liberalization in the context of the resurgence of protectionism. It also discusses the prospect of global trade liberalization based on the electronic commerce model and the network autonomy system in the future network economy. Therefore, this paper will discuss the legal significance of electronic commerce from the characteristics of traditional trade, and analyze the interaction between electronic commerce and international economic and trade law. And further discuss the impact of this interaction on the liberalization of international trade, thus proving that the fundamental resistance to free trade comes from the regional economy, and that the inherent characteristics of electronic commerce can be described as "anti-" regional economies. E-commerce requires and accelerates the disintegration of "national boundaries", which promotes the unification of international commercial law by breaking up regional economies, shaking national regulation, attacking the traditional legal system based on the region, and so on. On the other hand, the traditional law, while trying to bring electronic commerce into its control, has been influenced by the characteristics of the liberalization of electronic commerce and has turned towards liberalization. On the basis of this conclusion, This paper further looks forward to: under the trend of globalization of information economy, under the request of booming electronic commerce, if international economic and trade law dare to reform in a radical way, network autonomy-at least network economic autonomy-will become possible, at the same time, The ideal of free trade would be closer to reality.
