【摘要】: 貨物交付是海上貨物運(yùn)輸下承運(yùn)人承擔(dān)的重要義務(wù),也是貨物運(yùn)輸合同的主要目的,往往導(dǎo)致貨物運(yùn)輸合同的終結(jié)。盡管貨物交付是海上貨物運(yùn)輸中的關(guān)鍵一環(huán),但在《鹿特丹規(guī)則》之前的國(guó)際公約,如《海牙規(guī)則》、《漢堡規(guī)則》當(dāng)中,對(duì)承運(yùn)人交貨義務(wù)的規(guī)定比較零散,在很多問題的規(guī)定上存在很多空白和不足,很難就貨物交付為航運(yùn)實(shí)踐和司法審判提供足夠指引!堵固氐ひ(guī)則》首次作為一個(gè)調(diào)整海上貨物運(yùn)輸?shù)膰?guó)際公約,對(duì)貨物交付問題進(jìn)行了全面細(xì)致、系統(tǒng)詳盡的規(guī)定,為航運(yùn)實(shí)踐中貨物交付問題的處理提供了依據(jù),除此,《鹿特丹規(guī)則》針對(duì)航運(yùn)實(shí)踐中就貨物交付經(jīng)常出現(xiàn)的一些問題提出了創(chuàng)新的解決方法,彌補(bǔ)了現(xiàn)行國(guó)際公約的不足。從這些方面看,《鹿特丹規(guī)則》所具有的積極意義是不言而喻的,然而任何一個(gè)國(guó)際公約的產(chǎn)生都是多方利益相互調(diào)和的結(jié)果,在這一過程中,必然會(huì)犧牲某些利益方的利益,這就導(dǎo)致這一國(guó)際公約在實(shí)際操作中會(huì)產(chǎn)生一些難以預(yù)料的問題,《鹿特丹規(guī)則》當(dāng)然也不例外。 本文立足《鹿特丹規(guī)則》第九章關(guān)于貨物交付的規(guī)定,共分為五章。第1章介紹了貨物交付的基本概念、類型,以及它的歷史沿革。第2章詳細(xì)分析了《鹿特丹規(guī)則》下承運(yùn)人在簽發(fā)不同類型的運(yùn)輸單證或者電子運(yùn)輸記錄時(shí)具體的交貨義務(wù),以及控制權(quán)對(duì)承運(yùn)人交貨義務(wù)的影響。第3章介紹了《鹿特丹規(guī)則》有關(guān)無單放貨問題的創(chuàng)新規(guī)定。第4章闡述了《鹿特丹規(guī)則》下承運(yùn)人遭遇交貨受阻時(shí)的權(quán)利義務(wù)。第5章是對(duì)《鹿特丹規(guī)則》關(guān)于貨物交付規(guī)定的評(píng)價(jià)以及對(duì)我國(guó)《海商法》的借鑒。 作者希望通過本文的研究,進(jìn)一步明確《鹿特丹規(guī)則》關(guān)于貨物交付規(guī)定的積極意義以及不足之處,以對(duì)我國(guó)《海商法》的完善有所裨益,并能夠?yàn)楹竭\(yùn)實(shí)踐提供理論依據(jù)。
[Abstract]:Delivery of goods is an important obligation assumed by the carrier under carriage of goods by sea and the main purpose of a contract of carriage of goods, often leading to the termination of a contract of carriage of goods, although delivery of goods is a key link in the carriage of goods by sea. However, in the international conventions before the Rotterdam rules, such as the Hague rules and the Hamburg rules, the provisions on the carrier's obligation to deliver goods are relatively fragmented, and there are many gaps and deficiencies in the provisions on many issues. It is difficult to provide sufficient guidance on the delivery of goods for shipping practice and judicial trials. For the first time, the Rotterdam rules, as an international convention regulating the carriage of goods by sea, provide comprehensive, detailed and systematic provisions on the delivery of goods, It provides the basis for handling the problem of goods delivery in shipping practice. In addition, the Rotterdam rules provide innovative solutions to some problems that often arise in shipping practice. From these aspects, the positive significance of the Rotterdam rules is self-evident. However, the emergence of any international convention is the result of the reconciliation of various interests, and in this process, It is inevitable that the interests of some stakeholders will be sacrificed, which will lead to some unpredictable problems in the practical operation of this international convention, and the Rotterdam rules are no exception. Based on the provisions of Chapter 9th of the Rotterdam rules on the delivery of goods, this paper is divided into five chapters. Chapter 1 introduces the basic concepts and types of delivery of goods. Chapter 2 analyzes in detail the specific delivery obligations of carriers when issuing different types of transport documents or electronic transport records under the Rotterdam rules, Chapter 3 introduces the innovative provisions of the Rotterdam rules on the delivery of goods without documents. Chapter 4 expounds the rights of the carrier when the delivery of goods is blocked under the Rotterdam rules. Chapter 5 is the evaluation of the provisions of the Rotterdam rules on the delivery of goods and the reference to the Maritime Law of China. The author hopes to further clarify the positive significance and deficiencies of the Rotterdam rules on the delivery of goods through the study of this paper, so as to be of benefit to the perfection of Maritime Law of China and to provide theoretical basis for shipping practice.
