【摘要】： 世界貿(mào)易組織(WTO)的《與貿(mào)易有關(guān)的知識產(chǎn)權(quán)協(xié)議》(以下簡稱TRIPS協(xié)議)生效后，國際著作權(quán)保護(hù)呈現(xiàn)了新的趨勢，我國在加入WTO前后對于相關(guān)的著作權(quán)法律也進(jìn)行了修訂。本文就是在我國加入WTO這一背景下，，系統(tǒng)地總結(jié)了WTO中的TRIPS協(xié)議關(guān)于著作權(quán)的保護(hù)規(guī)定和我國加入WTO后著作權(quán)保護(hù)的重大意義�；赪TO中的TRIPS協(xié)議，重點研究了加入WTO前后我國著作權(quán)保護(hù)立法和執(zhí)法的調(diào)整，立法的調(diào)整主要體現(xiàn)在著作權(quán)法的修訂，新的著作權(quán)法擴(kuò)大了著作權(quán)的保護(hù)客體和保護(hù)范圍，增加了著作權(quán)人和鄰接權(quán)所有者的權(quán)利，縮小了著作權(quán)權(quán)利的限制范圍，嚴(yán)格了法律責(zé)任，信息網(wǎng)絡(luò)傳播權(quán)和數(shù)據(jù)庫等匯編作品納入保護(hù)范圍，同時加強了行政和司法執(zhí)法力度。針對網(wǎng)絡(luò)環(huán)境對著作權(quán)保護(hù)提出的新問題，探討了加入WTO以后與網(wǎng)絡(luò)環(huán)境有關(guān)的互聯(lián)網(wǎng)和數(shù)據(jù)庫的著作權(quán)保護(hù)法律問題，闡明了我國互聯(lián)網(wǎng)和數(shù)據(jù)庫著作權(quán)保護(hù)的必要性。最后，根據(jù)我國目前的形勢和WTO的發(fā)展趨勢，提出了加入WTO后我國著作權(quán)保護(hù)制度的完善方法和對策建議。
[Abstract]:After the WTO Agreement on Trade-Related aspects of intellectual property Rights (hereinafter referred to as the TRIPS Agreement) came into effect, the international copyright protection has taken on a new trend. Before and after China's entry into WTO, the relevant copyright laws have also been revised. This paper is based on the background of China's entry into WTO. This paper systematically summarizes the copyright protection regulations of TRIPS agreement in WTO and the great significance of copyright protection after China's entry into WTO. Based on the TRIPS protocol in WTO, this paper focuses on the adjustment of copyright protection legislation and law enforcement before and after China's entry into WTO. The legislative adjustment is mainly reflected in the revision of the copyright Law. The new copyright Law expands the object and scope of copyright protection, increases the rights of copyright owners and neighboring rights owners, and narrows the limits of copyright rights. Strict legal liability, the right to disseminate information on the Internet and databases and other compilation works have been brought into the scope of protection. At the same time, administrative and judicial enforcement efforts have been strengthened, and new issues concerning copyright protection in the network environment have been raised. This paper probes into the legal problems of copyright protection of Internet and database related to the network environment after China's entry into WTO, and expounds the necessity of copyright protection of Internet and database in China. Finally, according to the current situation of our country and the developing trend of WTO, This paper puts forward the perfect methods and countermeasures of copyright protection system after China's entry into WTO.
