【摘要】:保險賠償責任是指在財產(chǎn)保險中被保險人與保險人簽訂保險合同,將特定的 風險轉由保險人承擔。當保險標的發(fā)生了承保責任范圍內(nèi)的損失時,保險人應當 按照保險合同條款的規(guī)定履行全部賠償責任。保險的基本原則和制度(即保險利 益原則、最大誠信原則、近因原則、委付、代位求償制度)是保險法特別是海上 保險法中極其重要的方面,其關系到保險合同的有效與否,以及保險事故發(fā)生后 諸多賠償方面的問題,因此在實務中經(jīng)常成為當事人爭議的焦點。然而我國《保 險法》及《海商法》對此僅做了原則性規(guī)定,并不詳盡,在實務中經(jīng)常引起糾紛。 在海上保險中,保險利益的存在是投保人或被保險人獲得保險賠償?shù)谋匾疤帷?海上保險合同是建立在最大誠信基礎上的。對保險標的損害結果與承保危險之間 要以“近因原則”為基礎。發(fā)生保險事故后,在一定條件下,可以進行委付。涉 及第三方責任的,保險人賠償后,應行使代位求償權。本文試圖結合我國保險實 務和英國《1906年海上保險法》及其他國家的海上保險法律的規(guī)定,結合保險 的基本原則和制度,對海上保險人判定一起海上事故是否屬于海上保險的賠償責 任,何時賠償,如何賠償,以及賠償中應注意的問題進行了初步分析和探討,以 期對海上保險事業(yè)獻以微薄之力。
