The conclusion is that the stipulations in the Maritime Code of P. R. C. are consistent with 1993 convention and it is time for us to ratify 1993 convention.

Abstract As a kind of special real right fixed by maritime law,maritime liens are valid without record and possession.Moreover,maritime law expressly provides that maritime liens are superior to maritime mortgages.As a consequence,this causes the conflict of interest between maritime liens and maritime mortgages.This paper takes the balancing of interest as its object and set forth some new suggestions.
船舶優(yōu)先權(quán)是海商法規(guī)定的一種特殊物權(quán),由于其無(wú)需登記或占有即可有效成立,且海商法明確規(guī)定其效力優(yōu)先于船舶抵押權(quán),因此這勢(shì)必導(dǎo)致船舶優(yōu)先權(quán)與船舶抵押權(quán)之間的利益沖突。本文著重對(duì)二者的利益沖突進(jìn)行了衡量并提出了一些新的觀點(diǎn)。
There are three ways of enforcement of maritime liens. Being arrested of the particular ship is condition of the enforcement. The maritime court arrested the particular ship has exclusive jurisdiction on the acknowledgement and enforcement of maritime liens. This paper analyses how the procedure of maritime enterprise bankruptcy affects the enforcement of maritime liens. Several suggestions are also given in this paper.
船舶優(yōu)先權(quán)的行使方式有三種 :扣船行使、賣船行使、參與分配行使。當(dāng)事船舶被依法扣押是船舶優(yōu)先權(quán)的行使條件。船舶扣押地法院對(duì)船舶優(yōu)先權(quán)的確認(rèn)和行使具有專門管轄權(quán)。本文分析了船舶優(yōu)先權(quán)的行使特性 ,船舶運(yùn)輸企業(yè)、海上生產(chǎn)企業(yè)破產(chǎn)程序?qū)Υ皟?yōu)先權(quán)行使的影響 ,并提出了建議。
