【摘要】：“棄權(quán)”與“失權(quán)”是保險中最基本的法律范疇,而我國現(xiàn)行的《保險法》、《海商法》對其規(guī)定很少,在理論上,沒有按誠實信用原則建立起完備的保險合同中保險人的“棄權(quán)”與“失權(quán)”制度;在實務(wù)中,尤其是在海上保險和人壽保險中,在履行保險合同的各個環(huán)節(jié)上卻經(jīng)常出現(xiàn)形形色色的“棄權(quán)”與“失權(quán)”的情形,迫切需要理論或者法律的支持。本文通過研究“棄權(quán)”與“失權(quán)”在英美和其他保險業(yè)發(fā)達國家的運用,反思我國《保險法》、《海商法》的現(xiàn)狀,以期為其完善提出一些可行性建議。
[Abstract]:"waiver" and "loss of right" are the most basic legal categories in insurance, but in our country, the current Insurance Law and Maritime Law have few provisions on them. The system of "waiver" and "loss of rights" of insurers in insurance contracts has not been established according to the principle of good faith, and in practice, especially in marine insurance and life insurance, In all aspects of the performance of the insurance contract, however, there are often various cases of "waiver" and "loss of power". By studying the application of "waiver" and "loss of power" in the United States and other developed insurance countries, this paper reflects on the present situation of China's Insurance Law and Maritime Law. With a view to its improvement put forward some feasible suggestions.
