國(guó)際多式聯(lián)運(yùn)經(jīng)營(yíng)人責(zé)任法律制度研究

【摘要】: 國(guó)際貨物多式聯(lián)運(yùn)是不同于其他運(yùn)輸方式的一種新型運(yùn)輸方式,也是國(guó)際貿(mào)易不可缺少的組成部分,并在世界經(jīng)濟(jì)發(fā)展中扮演著越來(lái)越重要的角色。但是,由于目前國(guó)際上缺少調(diào)整貨物多式聯(lián)運(yùn)相對(duì)統(tǒng)一的法律制度,很大程度上制約著國(guó)際貨物多式聯(lián)運(yùn)的進(jìn)一步發(fā)展。因此,作為多式聯(lián)運(yùn)的核心體系,研究多式聯(lián)運(yùn)中經(jīng)營(yíng)人的責(zé)任并制訂一套合理有效的體系,對(duì)解決目前法律適用混亂的局面以及促進(jìn)多式聯(lián)運(yùn)的發(fā)展,都是具有積極意義的。 本文在中國(guó)加入WTO、加快對(duì)外開(kāi)放與完善國(guó)內(nèi)法律法規(guī)的背景下,將相關(guān)法學(xué)理論與國(guó)際貨物多式聯(lián)運(yùn)的業(yè)務(wù)實(shí)踐及我國(guó)具體情況相結(jié)合,圍繞著當(dāng)前國(guó)際立法上現(xiàn)存的三個(gè)多式聯(lián)運(yùn)規(guī)則:ICC1973規(guī)則、MTC1980、UNCTAD/ICC1992規(guī)則展開(kāi);以民商法和運(yùn)輸法的基本理論為依據(jù),明確了多式聯(lián)運(yùn)經(jīng)營(yíng)人的法律地位后,以多式聯(lián)運(yùn)經(jīng)營(yíng)人責(zé)任類型、責(zé)任期間、賠償責(zé)任基礎(chǔ)、賠償責(zé)任限制及免責(zé)事由為中心進(jìn)行分析論證;采用經(jīng)修訂的統(tǒng)一責(zé)任制,將嚴(yán)格責(zé)任原則作為多式聯(lián)運(yùn)經(jīng)營(yíng)人的歸責(zé)原則更加符合國(guó)際多式聯(lián)運(yùn)的發(fā)展趨勢(shì)。同時(shí)在比較不同國(guó)際公約和慣例對(duì)有關(guān)多式聯(lián)運(yùn)經(jīng)營(yíng)人責(zé)任制度規(guī)定的優(yōu)缺點(diǎn)后,文章認(rèn)為建立一個(gè)完善的多式聯(lián)運(yùn)經(jīng)營(yíng)人責(zé)任制度體系,逐漸使我國(guó)立法與國(guó)際通行做法相協(xié)調(diào),才能最大程度協(xié)調(diào)貨運(yùn)雙方利益,使我國(guó)多式聯(lián)運(yùn)經(jīng)營(yíng)人責(zé)任制度盡快適應(yīng)經(jīng)濟(jì)發(fā)展并與國(guó)際接軌。
[Abstract]:International multimodal transport of goods is a new mode of transport, which is different from other modes of transport. It is also an indispensable part of international trade and plays an increasingly important role in the development of the world economy. Due to the lack of a relatively uniform international legal system to adjust multimodal transport of goods, which to a large extent restricts the further development of international multimodal transport of goods, it is the core system of multimodal transport. It is of positive significance to study the responsibility of the operator in multimodal transport and to establish a set of reasonable and effective system to solve the confusion in the application of law and to promote the development of multimodal transport. Under the background of China joining WTO, speeding up opening to the outside world and perfecting domestic laws and regulations, this paper combines the relevant legal theories with the business practice of international multimodal transport of goods and the specific conditions of our country. Around the three existing multimodal transport rules in current international legislation: ICC1973 rule and UNCTAD / ICC1992 rule MTC1980. Based on the basic theory of civil and commercial law and transport law, this paper clarifies the legal status of multimodal transport operator, and then defines the type of liability of multimodal transport operator. During the period of liability, the basis of liability, limitation of liability and reasons for exemption shall be the center of analysis and argumentation; the revised unified responsibility system shall be adopted. The principle of strict liability as the principle of liability of multimodal transport operators is more in line with the development trend of international multimodal transport. At the same time, after comparing the advantages and disadvantages of different international conventions and practices on the liability system of multimodal transport operators, The article thinks that only by establishing a perfect system of multimodal transport operator's liability system, and gradually harmonizing our country's legislation with international common practice, can we coordinate the interests of both parties to freight transport to the greatest extent. Make our country multimodal transport operator responsibility system to adapt to economic development and international integration as soon as possible.
