船舶承租人的海事賠償責(zé)任限制問題研究

【摘要】: 隨著海運(yùn)業(yè)多元化的發(fā)展,海事賠償責(zé)任限制主體的范圍不斷擴(kuò)大。對(duì)海事賠償責(zé)任限制制度影響最大的1976年《海事賠償責(zé)任限制公約》將船舶承租人歸入船舶所有人,賦予其責(zé)任限制的權(quán)利,但公約未明確規(guī)定承租人的范圍和可限制責(zé)任的索賠的范圍。本文主要以《1976年公約》和我國《海商法》的相關(guān)規(guī)定為背景,針對(duì)享受海事賠償責(zé)任限制的船舶承租人的范圍問題及可限制責(zé)任的索賠范圍問題,結(jié)合航運(yùn)和司法實(shí)踐,運(yùn)用歷史分析、案例分析、立法比較的方法進(jìn)行研究。在此基礎(chǔ)之上,明確了享受海事賠償責(zé)任限制的船舶承租人的范圍以及限制性債權(quán)的范圍,最后提出對(duì)我國《海商法》的相關(guān)修改建議。 全文共分四個(gè)章節(jié):第一章通過對(duì)相關(guān)國際公約和國內(nèi)外立法的研究,以及對(duì)典型案例的分析,總結(jié)出了實(shí)踐中亟待解決的兩個(gè)問題,即本文的探討重點(diǎn);第二章從海事賠償責(zé)任限制的產(chǎn)生發(fā)展、設(shè)立意義及性質(zhì)等相關(guān)理論問題入手,確立了判斷海事賠償責(zé)任限制主體的標(biāo)準(zhǔn),即基于船舶的經(jīng)營或收益的標(biāo)準(zhǔn)。同時(shí)結(jié)合各類承租人的性質(zhì)與特征,分別判斷他們是否可以成為海事賠償責(zé)任限制的主體;第三章將能夠享受海事賠償責(zé)任限制的索賠分為三大類來具體分析限制性債權(quán)的范圍;最后一章在前文研究的基礎(chǔ)之上,對(duì)我國現(xiàn)行立法中的相關(guān)條文進(jìn)行分析,并提出立法建議。 通過本文的研究,筆者得出以下幾點(diǎn)結(jié)論:(1)現(xiàn)今,海事賠償責(zé)任限制主體享受責(zé)任限制的法理基礎(chǔ)是基于對(duì)船舶的經(jīng)營或收益;(2)能夠享受海事賠償責(zé)任限制的船舶承租人應(yīng)當(dāng)包括光船承租人、定期承租人、航次承租人以及艙位承租人;(3)結(jié)合《海商法》第207條的規(guī)定和各類責(zé)任主體自身的性質(zhì)和特征,完全可以判斷出責(zé)任主體對(duì)某一類海事請(qǐng)求是否可以享受海事賠償責(zé)任限制,因此,對(duì)于《海商法》第207條的規(guī)定應(yīng)當(dāng)繼續(xù)維持。
[Abstract]:With the diversified development of maritime industry, the scope of the subject of limitation of liability for maritime claims is expanding continuously. The Convention on limitation of liability for Maritime claims of 1976, which has the greatest influence on the system of limitation of liability for maritime claims, classifies the charterer as the owner of the ship. However, the scope of the lessee and the scope of the claim for the limitation of liability are not clearly stipulated in the convention. This article mainly takes the Convention of 1976 and the relevant provisions of the Maritime Law of China as the background. In view of the scope of the charterer who enjoys the limitation of the liability for maritime claims and the scope of the claim for the limitation of liability, combined with shipping and judicial practice, historical analysis and case analysis are used. On the basis of this, the scope of charterers who enjoy the limitation of liability for maritime claims and the scope of restrictive claims are clarified. Finally, some suggestions for amending the Maritime Law of China are put forward. The full text is divided into four chapters: the first chapter through the relevant international conventions and domestic and foreign legislation, as well as the analysis of typical cases, summed up the practice of two urgent problems, that is, the focus of this paper; The second chapter starts with the related theoretical problems, such as the emergence and development of the limitation of liability for maritime claims, the significance and nature of the establishment and so on, and establishes the criteria for judging the subject of the limitation of liability for maritime claims. That is to say, based on the standard of ship operation or profit, combined with the nature and characteristics of all kinds of charterers, whether they can be the subject of limitation of liability for maritime claims; The third chapter will be able to enjoy the limitation of maritime claims claims into three categories to specifically analyze the scope of restrictive claims; the last chapter on the basis of the previous study, the current legislation of our country to analyze the relevant provisions, And put forward legislative suggestions. Through the study of this paper, the author draws the following conclusions:. The legal basis of the limitation of liability for maritime claims is that the charterer who can enjoy the limitation of liability for maritime claims shall include the bareboat charterer and the time charterer. Combined with the provisions of Article 207 of the Maritime Law and the nature and characteristics of all kinds of subjects of responsibility, it is entirely possible to judge whether the subject of responsibility may enjoy the limitation of liability for a certain type of maritime claim. Therefore, the provisions of article 207 of the Maritime Code shall continue to be maintained.
