【摘要】：為了防范賭博和道德風險,海上保險利益原則應運而生。但是保險利益原則自誕生之日起,圍繞法定利益理論和實際期待利益理論的爭論就從來沒有停止過。保險利益原則具體內(nèi)涵的不確定性,給海上保險實務帶來很大的困惑和負面作用。本文將以海上保險利益原則的產(chǎn)生、發(fā)展、變化、廢除為主線,結合國內(nèi)外立法和司法實踐,探討海上保險利益原則產(chǎn)生長期而持久爭議的深層次原因,廢除保險利益原則理論,可能的改良方案以及我國海商法修改時應當如何規(guī)范保險利益原則。 本文分為四章。第一章簡要概述海上保險利益原則的含義,海上保險利益原則確立過程及意義等;第二章結合案例及立法闡述保險利益原則從“法定利益理論”到“實際期待利益理論”的變遷過程,著重闡述了法定利益理論實際利益理論兩者的區(qū)別及各自的優(yōu)點、缺點,以及保險利益原則給司法實踐帶來的不確定性及不公平等問題;第三章對廢除保險利益原則的思潮進行闡述及評述,附帶筆者對保險利益原則改良的一些建議;第四章對我國海商法修改時保險利益原則如何規(guī)范提出一些自己的建議。
[Abstract]:In order to guard against gambling and moral hazard, the principle of marine insurance interests came into being. The controversy over the theory of statutory interest and the theory of actual expectation of interest has never stopped. The uncertainty of the specific connotation of the principle of insurance interests, It will bring great confusion and negative effect to marine insurance practice. This paper will take the emergence, development, change and abolishment of the benefit principle of marine insurance as the main line, combining the legislation and judicial practice at home and abroad. This paper probes into the deep-seated causes of the long-lasting dispute over the principle of marine insurance interests, the abrogation of the theory of the principle of insurance interests, the possible improvement scheme and how to standardize the principle of insurable interest when the maritime law of our country is amended. This paper is divided into four chapters. The first chapter gives a brief overview of the meaning of the principle of marine insurance interests, the process and significance of establishing the principle of interests of marine insurance. The second chapter expounds the change process of insurance interest principle from "legal interest theory" to "actual expectation interest theory", and emphasizes the difference between the two theories and their respective advantages and disadvantages. The third chapter expounds and comments on the trend of thought of abolishing the principle of insurance interest, with some suggestions on the improvement of the principle of insurance interest. Chapter 4th puts forward some suggestions on how to standardize the principle of insurance interest when the maritime law of our country is amended.
