【摘要】: 海上貨物運(yùn)輸法強(qiáng)制性體制構(gòu)成了運(yùn)輸法的特質(zhì),其貫穿海上貨物運(yùn)輸法立法的始終,一枝獨(dú)秀。論文對(duì)海上貨物運(yùn)輸法強(qiáng)制性體制進(jìn)行系統(tǒng)地綜合地考察,包括諸如歷史淵源、演進(jìn)的歷程、價(jià)值趨向、強(qiáng)制性體制的經(jīng)濟(jì)學(xué)分析以及中國(guó)合同法語(yǔ)境中強(qiáng)制性體制的現(xiàn)代化和本土化等一系列問(wèn)題。 第1章是海上貨物運(yùn)輸法強(qiáng)制性體制序說(shuō)。這一章具有導(dǎo)論的功能,是本文展開研究的基礎(chǔ)和前提。第2章的研究是以海上貨物運(yùn)輸法強(qiáng)制性體制的淵源的歷史解讀為核心而展開的。本章主要將研究的核心置于系統(tǒng)論下,講究對(duì)海上貨物運(yùn)輸法強(qiáng)制性體制淵源的歷史研究,從整體出發(fā)、注重綜合、立體網(wǎng)絡(luò)式思維。第3章主要以海上貨物運(yùn)輸法的立法歷程為線索,研究了海上貨物運(yùn)輸法強(qiáng)制性體制的發(fā)展過(guò)程,以達(dá)到全面地認(rèn)識(shí)海上貨物運(yùn)輸法強(qiáng)制性體制的目的。第4章在法哲學(xué)的研究范式下對(duì)海上貨物運(yùn)輸法強(qiáng)制性體制得以存在的價(jià)值進(jìn)行系統(tǒng)地分析,著重解答海上貨物運(yùn)輸法緣何對(duì)維系強(qiáng)制性體制“情有獨(dú)鐘”。論文提出了海上貨物運(yùn)輸法強(qiáng)制性體制價(jià)值論的“二維價(jià)值結(jié)構(gòu)”。第5章是對(duì)海上貨物運(yùn)輸法強(qiáng)制性體制的深入研究,主要采用法律經(jīng)濟(jì)學(xué)的研究手段,對(duì)海上貨物運(yùn)輸法強(qiáng)制性體制的存廢展開經(jīng)濟(jì)學(xué)視域內(nèi)的考證。第6章研究中國(guó)合同法語(yǔ)境下海上貨物運(yùn)輸法強(qiáng)制性體制的本土化問(wèn)題。 論文提出海上貨物運(yùn)輸法強(qiáng)制性體制的自足性理論,運(yùn)用實(shí)證分析方法在“海商文化”維度下對(duì)海上貨物運(yùn)輸?shù)葟?qiáng)制性體質(zhì)進(jìn)行獨(dú)特視角的論證。作為海上貨物運(yùn)輸法強(qiáng)制性體價(jià)值論——二維價(jià)值結(jié)構(gòu)論的佐證,在法經(jīng)濟(jì)學(xué)的視野下全面地分析了海上貨物運(yùn)輸法強(qiáng)制性體制,提出了“軟化的多層次強(qiáng)制性體制”的觀點(diǎn),并對(duì)強(qiáng)制性體制之下的交易主體、交易合同類型、義務(wù)和責(zé)任等范疇進(jìn)行了重新考察。在考察我國(guó)《海商法》第4章的缺憾基礎(chǔ)之上,以強(qiáng)制性法律規(guī)范的基礎(chǔ)理論為根基,提出了強(qiáng)制性規(guī)范的軟化處理模式,并提出了我國(guó)《海商法》第4章對(duì)于強(qiáng)制性規(guī)范的配置的新方案。
[Abstract]:The compulsory system of the law of carriage of goods by sea constitutes the characteristics of the law of carriage by sea, which runs through the legislation of the law of carriage of goods by sea. It includes a series of problems, such as historical origin, evolution course, value trend, economic analysis of mandatory system and modernization and localization of compulsory system in the context of Chinese contract law. Chapter 1 is the mandatory institutional preface of the law of carriage of goods by sea. This chapter has the function of introduction. Chapter 2 is based on the historical interpretation of the compulsory system of the carriage of goods by sea. This chapter puts the core of the study under the system theory. Pay attention to the historical research of the compulsory system origin of the law of carriage of goods by sea, from the whole, pay attention to the thinking of synthesis and three-dimensional network. Chapter 3 mainly takes the legislative course of the law of carriage of goods by sea as the clue. Having studied the development of the compulsory system of the law of carriage of goods by sea, In order to achieve a comprehensive understanding of the mandatory system of the carriage of goods by sea. Chapter 4 systematically analyzes the value of the compulsory system of the carriage of goods by sea under the research paradigm of legal philosophy. In this paper, the author puts forward the "two-dimensional value structure" of the mandatory system value theory of the maritime freight transport law. Chapter 5 is about the enforcement of the law on the carriage of goods by sea. An in-depth study of the sexual system, By means of legal and economic research, this paper makes a study of the compulsory system of the carriage of goods by sea from the perspective of economics. Chapter 6 studies the localization of the compulsory system of the law of carriage of goods by sea in the context of Chinese contract law. The paper puts forward the theory of self-sufficiency of compulsory regime in the law of carriage of goods by sea. Using the method of empirical analysis to demonstrate the compulsory constitution such as the carriage of goods by sea in the dimension of "maritime commerce culture". It is the proof of the theory of mandatory body value of the law of carriage of goods by sea-two-dimensional value structure theory. In the view of law and economics, the compulsory system of the law of carriage of goods by sea is comprehensively analyzed, and the viewpoint of "softened multi-level compulsory system" is put forward, and the subject of transaction and the type of transaction contract under the compulsory system are also discussed. On the basis of reviewing the defects of Chapter 4 of the Maritime Code of China, and taking the basic theory of compulsory legal norms as the foundation, this paper puts forward the softening treatment mode of mandatory norms. Chapter 4 of Maritime Code of China puts forward a new scheme for the allocation of mandatory norms.
