我國(guó)海上貨物留置權(quán)問題的法律思考

【摘要】: 隨著航運(yùn)事業(yè)的不斷發(fā)展,海上貨物留置權(quán)仍是海上運(yùn)輸中發(fā)生糾紛較多的問題,而我國(guó)《海商法》關(guān)于貨物留置權(quán)的規(guī)定僅見于第87,88條。留置權(quán)的正確行使無論對(duì)于承運(yùn)人債權(quán)的保障還是貨主正當(dāng)權(quán)益的維護(hù)都是極為重要的,其作為一種重要的擔(dān)保方式在海上運(yùn)輸領(lǐng)域發(fā)揮著重要的作用。 本文通過分析海上貨物留置權(quán)的成立要件,法律屬性及行使等問題,提出自己的看法,第一章主要介紹海上貨物留置權(quán)的基本理論,第二,三,四章主要論述海上貨物留置權(quán)的成立要件,法律關(guān)系分析以及行使情況,第五章分析相關(guān)法律未做修改的原因,并提出作者的完善海上貨物留置權(quán)法律制度的建議,通過以上幾章,圍繞著合法占有,留置物的所有權(quán)歸屬關(guān)系,目的港留置等核心問題進(jìn)行論述,試圖解決承運(yùn)人在目的港行使貨物留置權(quán)的問題,盡可能平衡船貨雙方的利益,促進(jìn)航運(yùn)事業(yè)的健康發(fā)展,希望通過本文的論述,能為海上貨物留置權(quán)法律制度的完善盡一點(diǎn)自己的綿薄之力。
[Abstract]:With the continuous development of shipping industry, the lien of goods by sea is still a more controversial issue in maritime transportation. However, the provisions of China's Maritime Law on the lien of goods are only found in Article 8788. The correct exercise of lien is of great importance to the protection of the carrier's creditor's rights and the maintenance of the proper rights and interests of the cargo owner. As an important way of guarantee, it plays an important role in the field of maritime transport. In this paper, the author puts forward his own views by analyzing the elements of establishment, legal attribute and exercise of the lien of marine cargo. The first chapter mainly introduces the basic theory of lien of marine cargo, the second, third, and so on. The four chapters mainly discuss the requirements of the establishment of the lien of marine cargo, the analysis of legal relations and the situation of its exercise. Chapter 5th analyzes the reasons why the relevant laws have not been modified, and puts forward the author's suggestions on how to perfect the legal system of lien on marine cargo. Through the above chapters, the author discusses the core issues such as legal possession, the ownership of the lien, the port of destination and so on, in order to solve the problem of the carrier exercising the right of lien in the port of destination, and to balance the interests of both the ship and the cargo as much as possible. In order to promote the healthy development of shipping industry, it is hoped that, through the discussion of this paper, we can do our best to perfect the legal system of lien on marine cargo.
