在世界范圍內(nèi)社交平臺(tái)的用戶數(shù)據(jù)泄漏事件頻發(fā)的背景下,本文通過對(duì)比美國及歐盟在網(wǎng)絡(luò)隱私權(quán)法律法規(guī)及保護(hù)模式,對(duì)中國網(wǎng)絡(luò)隱私權(quán)保護(hù)提出增強(qiáng)行業(yè)自律,及在立法和執(zhí)法領(lǐng)域進(jìn)行改革的建議。美國保護(hù)用戶隱私以行業(yè)自律為主,一系列針對(duì)不同領(lǐng)域的法律法規(guī)為輔。無約束力的行業(yè)自律對(duì)數(shù)據(jù)驅(qū)動(dòng)的企業(yè)發(fā)展影響較小,但并不能有效地保護(hù)用戶數(shù)據(jù)隱私。不同領(lǐng)域的法律法規(guī)保護(hù)了特殊群體,例如未成年人,或?qū)φ@取公民信息進(jìn)行約束,但美國仍缺乏完善的網(wǎng)絡(luò)隱私保護(hù)法。而相較之下歐盟側(cè)重于采納嚴(yán)格完善的法律法規(guī)約束企業(yè)。2018年出臺(tái)的《通用數(shù)據(jù)保護(hù)條例》堪稱史上最為嚴(yán)苛的用戶隱私保護(hù)法,任何違反隱私保護(hù)要求的公司將面臨高額罰款。此舉較好地保護(hù)了用戶數(shù)據(jù)安全。從中國多家互聯(lián)網(wǎng)公司泄漏網(wǎng)絡(luò)用戶數(shù)據(jù)可看出,中國當(dāng)前對(duì)于互聯(lián)網(wǎng)用戶的隱私保護(hù)仍然不夠完善。《民法通則》僅規(guī)定自然人享有隱私權(quán),并提出保護(hù)自然人的個(gè)人信息�！毒W(wǎng)絡(luò)安全法》對(duì)數(shù)據(jù)收集者收集、利用用戶個(gè)人信息及懲處措施作出詳細(xì)規(guī)定,但完善的隱私法仍未建立,且缺乏數(shù)據(jù)保護(hù)機(jī)構(gòu)監(jiān)督。通過學(xué)習(xí)美國與歐盟經(jīng)驗(yàn),我國可通過加強(qiáng)行業(yè)自律、立法和執(zhí)法改革以保護(hù)用戶的網(wǎng)絡(luò)隱私權(quán)。中國可建立...
