【摘要】：文章對(duì)2011~2015五年間1730起著作權(quán)犯罪案件進(jìn)行了實(shí)證考察,旨在發(fā)現(xiàn)近年我國著作權(quán)犯罪的特點(diǎn)、趨勢(shì)以及司法實(shí)踐中存在的突出問題。通過實(shí)證研究發(fā)現(xiàn),目前我國著作權(quán)犯罪在數(shù)量上仍以傳統(tǒng)類型犯罪居多,涉及網(wǎng)絡(luò)的新型犯罪數(shù)量少但情節(jié)復(fù)雜、社會(huì)危害性大。著作權(quán)犯罪司法實(shí)踐中存在刑事司法資源分配失衡、法律適用標(biāo)準(zhǔn)混亂、被告人權(quán)利保障不足等問題。有必要通過調(diào)整司法資源配置、完善司法解釋規(guī)范審判裁量權(quán)、加強(qiáng)訴訟權(quán)利保障等,實(shí)現(xiàn)刑事司法對(duì)著作權(quán)的有效保護(hù)。
[Abstract]:This paper makes an empirical investigation on 1730 cases of copyright crime from 2011 to 2015, in order to find out the characteristics and trends of copyright crime in China in recent years and the outstanding problems existing in judicial practice. Through the empirical study, it is found that the number of copyright crimes in our country is still the traditional type of crime, the number of new crimes involving the network is small, but the plot is complex, and the social harm is great. In the judicial practice of copyright crime, there are some problems, such as the imbalance of the distribution of criminal judicial resources, the confusion of the applicable standards of the law, and the insufficient protection of the rights of the defendant. It is necessary to realize the effective protection of copyright in criminal justice by adjusting the allocation of judicial resources, perfecting judicial interpretation and standardizing trial discretion, strengthening the protection of litigation rights and so on.
