【摘要】：我國基本土地管理制度構(gòu)建了"征地開發(fā)"模式,"三舊"改造政策則構(gòu)建了"舊村改造"模式。二者應(yīng)該是相互平行的關(guān)系。而現(xiàn)階段,二者關(guān)系尚不清晰,"剪不斷,理還亂",造成了司法救濟、實務(wù)操作、理論研究諸多實際困惑和混亂。舊村改造與征地關(guān)系的癥結(jié)在于舊村改造集體土地轉(zhuǎn)性還必須依賴征收路徑。鑒于此,建議切分并重構(gòu)村改造與征地的關(guān)系,對集體土地轉(zhuǎn)性的法律依據(jù)進行梳理和調(diào)整,促進多種方式、多種路徑的土地轉(zhuǎn)性,并建立相關(guān)配套制度。
[Abstract]:The basic land management system of our country has constructed the mode of "land expropriation and development", while the policy of "three old" has constructed the mode of "reconstruction of old villages". The two should be parallel to each other. At this stage, the relationship between the two is not clear, "cut constantly, reason is still chaotic", resulting in judicial relief, practical operation, theoretical research a lot of practical confusion and confusion. The crux of the relationship between the transformation of old villages and land expropriation lies in the fact that the transformation of collective land in old villages must also rely on the expropriation path. In view of this, it is suggested that the relationship between village reconstruction and land expropriation should be divided and restructured, the legal basis of collective land conversion should be combed and adjusted, the land conversion in various ways and paths should be promoted, and the relevant supporting systems should be established.
