【摘要】：專(zhuān)利無(wú)效程序中權(quán)利要求解釋的尺度應(yīng)與權(quán)利要求允許修改的尺度相適應(yīng),從而保證專(zhuān)利權(quán)人所獲得的保護(hù)與其對(duì)現(xiàn)有技術(shù)的貢獻(xiàn)相匹配。針對(duì)我國(guó)當(dāng)前專(zhuān)利無(wú)效程序權(quán)利要求修改的嚴(yán)格限制,通過(guò)翔實(shí)的案例闡述當(dāng)前各種情形下專(zhuān)利無(wú)效程序中合理的權(quán)利要求解釋規(guī)則。
[Abstract]:The criterion of claim interpretation in patent invalidation procedure should be adapted to the criterion that the claim is allowed to be modified, so as to ensure that the protection obtained by the patentee matches its contribution to the existing technology. In view of the strict limitation of the revision of the right requirements of the current patent invalidation procedure in our country, this paper expounds the reasonable interpretation rules of the right requirements in the patent invalidation procedure under various circumstances through detailed cases.
