【摘要】：患者知情同意權行使在醫(yī)療實踐中廣泛存在,由于引入我國發(fā)展的時間不長,自身發(fā)展還不是很成熟,因此在我國的立法與實踐中知情同意權代理存在家屬或關系人表述和規(guī)定不明確、代理人代理行為與患者生命健康權存在沖突、代理人權限規(guī)定不明確等問題。文章通過對存在問題的分析,就知情同意權代理行使所存在的問題提出相應建議。
[Abstract]:The exercise of patients' right of informed consent widely exists in medical practice. Because the development of our country is not long and its own development is not very mature, there are some problems in the legislation and practice of our country, such as the expression and stipulation of family members or related persons, the conflict between agent agency behavior and patients' right to life and health, and the unclear stipulation of agent authority. Based on the analysis of the existing problems, this paper puts forward some suggestions on the problems existing in the exercise of the agent of informed consent.
