早期追續(xù)權立法評價

【摘要】：我國《著作權法》第三次修改中新增了追續(xù)權條款。為了完善我國追續(xù)權立法設計,有必要回溯早期追續(xù)權立法。早期的追續(xù)權立法主要采用單行法的形式對追續(xù)權進行規(guī)定,不同國家在追續(xù)權具體制度設計上存在較大差異,在立法設計上并未充分考慮制度的可操作性,但早期追續(xù)權制度確定了追續(xù)權的基本架構。早期追續(xù)權立法對于我國具有積極的借鑒意義,作為《伯爾尼公約》成員國,我國應遵守公約的規(guī)定,在外國作者適用追續(xù)權上采用互惠原則。我國在追續(xù)權立法設計上應充分考慮制度的可操作性,采用轉售總額為追續(xù)金計量基礎,并將私人交易排除出追續(xù)權的適用范圍,在追續(xù)權的運行上采用著作權集體管理模式,以保障追續(xù)權的運行效率。
[Abstract]:The right of pursuit clause has been added to the third revision of the copyright Law of our country. In order to perfect the legislative design of the right of pursuit in our country, it is necessary to go back to the legislation of the right of pursuit in the early stage. The early legislation of the right of pursuit mainly uses the form of single-line law to regulate the right of pursuit. There are great differences in the specific system design of the right of pursuit in different countries, and the maneuverability of the system has not been fully considered in the legislative design, but the basic structure of the right of pursuit has been determined by the system of the right of pursuit in the early stage. The legislation of early right of pursuit has positive reference significance for our country. As a member of the Berne Convention, our country should abide by the provisions of the Convention and adopt the principle of reciprocity in the application of the right of pursuit by foreign authors. In the legislative design of the right of pursuit, we should fully consider the maneuverability of the system, adopt the total amount of resale as the basis of the measurement of the right of recovery, exclude the applicable scope of the right of recovery from the private transaction, and adopt the mode of collective management of copyright in the operation of the right of pursuit in order to ensure the efficiency of the operation of the right of recovery.
