【摘要】：我們對按份共有內(nèi)部關系的研究就是在各按份共有人在對共有物的管理、使用、收益、處分中形成的各種權利義務關系,對于各權利義務如何分配。本文在討論的按份共有的內(nèi)部關系,主要涉及共有物的使用收益、共有物的處分、共有物的管理以及共有物費用的負擔四個方面,主要是因為這四個方面和各共有人的物質(zhì)利益緊密相連,而且共有人之間的爭議也大多數(shù)圍繞這兒個方面展開的。本文主要也是通過深入了解我國國內(nèi)目前對按份共有內(nèi)部關系的研究現(xiàn)狀,再比較分析域外如德國、日本、臺灣地區(qū)的有關按份共有內(nèi)部關系的研究情況,希望能夠借鑒德國、日本、臺灣地區(qū)的按份共有內(nèi)部關系的相關制度,通過圍繞按份共有人對共有物的使用收益、處分、管理以及費用負擔這四個問題進行研究,以期能夠?qū)θ绾瓮晟莆覈捶莨灿袃?nèi)部關系的相關法律的完善提出建議。
[Abstract]:The research on the internal relations by share is that the various rights and obligations in the management, the use, the income and the disposition of the common object are distributed in the parts, and how to distribute the rights and obligations. On the basis of the internal relations of the share, the article mainly deals with the use income of the common objects, the disposition of the common objects, the management of the common objects and the burden of the common objects, mainly because the four aspects are closely connected with the material interests of the people, And there's a lot of controversy around here, too. In this paper, the present situation of the current research on the internal relations of Germany, Japan and Taiwan has been compared and analyzed, and it is hoped to be able to learn from Germany, Japan, and Taiwan. According to the relevant system of the internal relations of the Taiwan area, the four problems, such as the use income, the disposal, the management and the cost burden of the common objects, are studied by a total of a total of people. In order to be able to make suggestions on how to improve the perfection of the relevant laws of our country's internal relations.
