【摘要】：我國現(xiàn)行法上的非法人組織(“其他組織”)與域外法上的非法人組織不具有等同意義,因此不能將我國現(xiàn)行法與域外法中的非法人組織混為一談,更不能將域外法有關(guān)非法人組織的經(jīng)驗(yàn)作為我國民法總則將現(xiàn)行法中的非法人組織(“其他組織”)設(shè)立為新類型民事主體的借鑒或參考。但是,我國現(xiàn)行法關(guān)于法人與非法人組織(“其他組織”)的劃分不具有科學(xué)性,不承認(rèn)未經(jīng)登記的組織的法律地位將難以適應(yīng)經(jīng)濟(jì)與社會(huì)發(fā)展的需要,域外法關(guān)于法人與非法人組織的劃分以及有限承認(rèn)未經(jīng)登記的組織的法律地位的立法和司法經(jīng)驗(yàn),值得我們參考。
[Abstract]:The non-legal person organization ("other organization") in the current law of our country is not of the same significance as the non-legal person organization in the foreign law, so it is impossible to confuse the current law of our country with the non-legal person organization in the foreign law. We can not regard the experience of foreign law on non-legal person organizations as the reference or reference for the general provisions of civil law of our country to set up the non-legal person organization ("other organizations") in the current law as the new type of civil subject. However, the division between legal persons and unincorporated organizations ("other organizations") in the current law of our country is not scientific, and it will be difficult to meet the needs of economic and social development if we do not recognize the legal status of unregistered organizations. The legislative and judicial experience of foreign law on the division of legal persons and unincorporated organizations and the limited recognition of the legal status of unregistered organizations is worthy of our reference.
