【摘要】：好意同乘在日常生活中非常普遍,在好意同乘中發(fā)生交通事故的糾紛最近幾年也比較多。應(yīng)該如何分配好意同乘中的交通事故責(zé)任?文章從引入現(xiàn)實(shí)生活中的兩個(gè)典型案例入手,結(jié)合案例和好意同乘的理論分析,探討好意同乘的性質(zhì),比較好意同乘與事實(shí)行為以及無(wú)償客運(yùn)合同的異同,在借鑒美國(guó),日本,德國(guó)和我國(guó)臺(tái)灣地區(qū)對(duì)好意同乘的歸責(zé)原則基礎(chǔ)上,建議我國(guó)應(yīng)適應(yīng)的歸責(zé)原則,同時(shí)根據(jù)在好意同乘中出現(xiàn)的不同責(zé)任情況討論其責(zé)任承擔(dān)問(wèn)題。
[Abstract]:The well-being is very common in daily life, and the dispute over the occurrence of traffic accidents has been more and more in recent years. How should I distribute the responsibility of the traffic accident in the kindness and the ride? Based on the two typical cases introduced in the real life, the article discusses the nature of the well-being by combining the theoretical analysis of the case and the well-being, and compares the similarities and differences between the well-meaning and the fact and the non-gratuitous passenger transport contract, and in the light of the United States, Japan, On the basis of the principle of imputation of well-being in Germany and Taiwan, it is suggested that our country should adapt to the principle of imputation, and discuss its liability according to the different responsibilities that arise in the case of well-being.
