【摘要】：某古裝電視劇的熱播給人們的生活增添了色彩,但在其播出不到一半的時(shí)候卻出現(xiàn)了問(wèn)題:在某網(wǎng)盤(pán)上竟然能搜索到全集。這種情況的發(fā)生不僅對(duì)發(fā)行商的利益進(jìn)行了侵犯,更是對(duì)著作權(quán)的權(quán)威進(jìn)行了挑戰(zhàn)。該網(wǎng)盤(pán)管理者得知該情形后即刻發(fā)聲,稱(chēng)已啟動(dòng)違規(guī)內(nèi)容整理預(yù)案,全力刪除有關(guān)資源。但依然有一些人,經(jīng)由多種渠道出售該電視劇的選集,售價(jià)在3元到8.8元不等。筆者認(rèn)為,要想認(rèn)定平臺(tái)能否侵權(quán),須要先厘清其能否實(shí)用避風(fēng)港準(zhǔn)繩;另外,網(wǎng)絡(luò)平臺(tái)介入選集資本生意業(yè)務(wù)的小我、賣(mài)家都應(yīng)承當(dāng)響應(yīng)的司法義務(wù)。
[Abstract]:The popularity of an ancient TV series adds color to people's lives, but there is a problem in less than half of its broadcast: the full episode can be searched on a net disk. The occurrence of this situation not only infringes on the interests of issuers, but also challenges the authority of copyright. The network manager immediately heard of the situation, saying that it had initiated illegal content collation plans and made every effort to delete the relevant resources. But there are still some people, through a variety of channels to sell the TV series anthology, the price ranges from 3 yuan to 8.8 yuan. The author believes that in order to determine whether the platform can infringe, it is necessary to clarify whether it can be a practical safe haven yard. in addition, the sellers who intervene in the capital business of the network platform should bear the judicial obligation of responding.
