【摘要】：我國現(xiàn)行繼承法未將基本原則條文化,學(xué)者對繼承法的基本原則多有討論,但鮮有將尊重被繼承人意志原則界定為繼承法的基本原則,更無人論證其于繼承法中的地位。自由價(jià)值是繼承法的根本價(jià)值,由繼承法的自由價(jià)值與本質(zhì)屬性所決定,尊重被繼承人意志原則應(yīng)當(dāng)為繼承法的基本原則,它貫穿于繼承法始終,不僅是遺囑繼承應(yīng)當(dāng)遵循的原則,而且是法定繼承應(yīng)當(dāng)遵循的原則,并且,是保護(hù)私人財(cái)產(chǎn)繼承權(quán)原則、繼承權(quán)平等原則、養(yǎng)老育幼等原則的邏輯前提,在繼承法的基本原則體系中居于核心地位。
[Abstract]:The current inheritance law of our country does not have the basic principle culture, scholars have much discussion on the basic principle of the inheritance law, but few define the principle of respecting the will of the heir as the basic principle of the inheritance law, and no one has proved its position in the inheritance law. The free value is the fundamental value of the inheritance law, which is determined by the free value and essential attribute of the inheritance law. The principle of respecting the will of the heir should be the basic principle of the inheritance law, which runs through the inheritance law all the time. It is not only the principle of testamentary succession, but also the principle of legal succession, and the logical premise of the principle of protecting private property inheritance right, the principle of equality of inheritance right, the principle of old-age care and so on. It occupies the core position in the basic principle system of inheritance law.
