博丹與普遍法的“國(guó)家”轉(zhuǎn)向

【摘要】:本文以博丹的早期著作為中心,追蹤歐洲近代早期羅馬法研究傳統(tǒng)的一次革命,它體現(xiàn)為一個(gè)以《民法大全》所象征的羅馬和帝國(guó)大一統(tǒng)為中心的普遍法傳統(tǒng),向以主權(quán)國(guó)家為中心的普遍法研究傳統(tǒng)的轉(zhuǎn)變!睹穹ù笕返"成文理性"地位、它作為帝國(guó)法權(quán)的象征、以及羅馬法學(xué)者圍繞《民法大全》研究所結(jié)成的跨國(guó)界的法律人共同體意識(shí)共同維系著《民法大全》作為普遍法的地位。但這種普遍法地位最終隨著人文主義方法的引入而遇到挑戰(zhàn),文字學(xué)的求真意識(shí)和"回到源頭"的立場(chǎng),瓦解了羅馬法歷史連續(xù)性的神話(huà),由此引入的歷史意識(shí)最終導(dǎo)向一種區(qū)別于羅馬的民族意志,它在意大利體現(xiàn)為古典主義的共和立場(chǎng),而在法國(guó)則體現(xiàn)為封建法研究的濫觴。通過(guò)對(duì)于兩個(gè)學(xué)派研究方法和問(wèn)題意識(shí)的揚(yáng)棄,博丹試圖建構(gòu)一個(gè)兼具理性意識(shí)和歷史經(jīng)驗(yàn)的新普遍法體系,它通過(guò)邏輯分類(lèi)保證科學(xué)性,通過(guò)萬(wàn)民法的填充保證普遍性。這樣做的后果就是將帝國(guó)傳統(tǒng)下的普遍法研究轉(zhuǎn)化為一個(gè)以尋找法律內(nèi)在精神和理性為要旨的法律科學(xué),由于國(guó)家在這種法律科學(xué)中的中心地位,這種法理學(xué)最終又落實(shí)為一種公法科學(xué)和政治科學(xué)。
[Abstract]:This article, centered on Boden's early works, tracks a revolution in the study tradition of Roman law in the early modern European times. It is a universal legal tradition characterized by the unity of Rome and the Empire, symbolized by the General Book of Civil Law. The transformation to the traditional study of universal law centered on sovereign states. The "formative and cultural" status of the General Book of Civil Law, as a symbol of the legal power of the Empire, And Roman legal scholars together maintain the status of civil law as a universal law around the consciousness of cross-border legal person community formed by the Institute of General History of Civil Law. However, this universal legal status eventually met with the challenge with the introduction of humanism. The consciousness of seeking truth in philology and the stand of "returning to the source" disintegrated the myth of the historical continuity of Roman law. Thus, the historical consciousness finally leads to a kind of national will which is different from that of Rome, which is embodied in the republicist position of classicism in Italy and the origin of feudal law study in France. Through the sublation of the research methods and the problem consciousness of the two schools, Boden tries to construct a new universal law system with both rational consciousness and historical experience, which guarantees the scientificalness through logical classification and the universality by filling in the universal civil law. The consequence of doing so is to transform universal legal research under the imperial tradition into a legal science based on the search for the inner spirit and reason of the law, given the centrality of the State in this legal science, This jurisprudence is finally implemented as a public law science and political science.
