【摘要】：專利制度是一種鼓勵(lì)創(chuàng)新、促進(jìn)創(chuàng)新成果傳播和利用的法律制度。以專利法為核心的專利制度通過具體的法律制度設(shè)計(jì)來實(shí)現(xiàn)其制度宗旨。作為一種鼓勵(lì)創(chuàng)新、進(jìn)而促進(jìn)經(jīng)濟(jì)社會(huì)發(fā)展的法律制度,專利制度也具有很強(qiáng)的經(jīng)濟(jì)理性,可以從經(jīng)濟(jì)學(xué)方面予以解構(gòu)和認(rèn)識(shí)。僅以專利授權(quán)為考察對(duì)象,尤其是其中的最優(yōu)保護(hù)期限與最優(yōu)保護(hù)寬度,亦能對(duì)專利法中的專利授權(quán)制度作出新的認(rèn)識(shí)與理解,而這對(duì)于深刻認(rèn)識(shí)專利法的制度精神也具有重要意義。
[Abstract]:Patent system is a legal system that encourages innovation and promotes the dissemination and utilization of innovation results. Patent law as the core of the patent system through the specific legal system design to achieve its system purpose. As a legal system to encourage innovation and promote economic and social development, patent system also has a strong economic rationality, which can be deconstructed and recognized from the aspect of economics. Only taking patent license as the object of investigation, especially the optimal protection period and the optimal protection width, it can also make a new understanding and understanding of the patent license system in the patent law. This is also of great significance to a deep understanding of the system spirit of patent law.
