論建筑物區(qū)分所有權(quán)專有部分和共有部分的劃分標(biāo)準(zhǔn)

【摘要】:自從建筑物區(qū)分所有權(quán)的出現(xiàn),我國(guó)理論界就對(duì)其進(jìn)行關(guān)注,并且在后來的立法界中確定下來,此時(shí)與建筑物區(qū)分所有權(quán)有關(guān)的理論研究就浩如煙海,但是,在實(shí)踐過程中,建筑物區(qū)分所有權(quán)制度仍然無法完全解決實(shí)務(wù)的諸多問題,如存在激烈爭(zhēng)議的小區(qū)停車位問題,會(huì)所架空層,等建筑物權(quán)屬的問題,正是因?yàn)檫@些爭(zhēng)議才會(huì)引起了社會(huì)矛盾,所以急需解決這些問題。本文主要根據(jù)建筑物區(qū)分所有權(quán)中的專有部分和共有部分劃分標(biāo)準(zhǔn)來入手,因?yàn)?正是劃分標(biāo)準(zhǔn)的不明確,才會(huì)引起相關(guān)問題。本文的主要研究路徑,首先,對(duì)建筑物區(qū)分所有權(quán)的相關(guān)理論進(jìn)行闡述,主要是對(duì)專有權(quán)和共有權(quán)進(jìn)行比較分析,其次,是列舉出建筑物區(qū)分所有權(quán)中專有權(quán)和共有權(quán)沖突中所出現(xiàn)的相關(guān)問題,然后,在針對(duì)各國(guó)的專有部分和共有部分相關(guān)法律規(guī)定,進(jìn)行比較分析,比較出哪些適合借鑒于我國(guó)建筑物區(qū)分所有權(quán)專有部分和共有部分劃分標(biāo)準(zhǔn),最后,針對(duì)我國(guó)建筑物區(qū)分所有權(quán)專有部分和共有部分應(yīng)該從哪幾方面入手,其中的主要目的是解決我國(guó)在建筑區(qū)分所有權(quán)中所存在的實(shí)務(wù)問題
[Abstract]:Since the emergence of the division of ownership of buildings, the theoretical circle of our country has paid close attention to it, and it has been determined in the later legislative circles. At this time, the theoretical research on the ownership of buildings is vast. However, in the process of practice, there is a great deal of research on the theory of division of ownership of buildings. The system of division of ownership of buildings is still unable to completely solve many practical problems, such as the problem of parking spaces in intensely disputed residential areas, the empty floors of the buildings, and so on. It is precisely because of these disputes that the social conflicts will be caused. So there is an urgent need to solve these problems. This paper is mainly based on the division standard of exclusive part and common part in the division of building ownership, because it is the unclear division standard that will lead to the related problems. The main research paths of this paper are as follows: firstly, the related theories of building division ownership are expounded, mainly the comparative analysis of exclusive rights and co-ownership rights, and the second is to make a comparative analysis of the exclusive rights and the co-ownership rights. Is to enumerate the related problems arising in the conflict of exclusive and shared rights in the division of ownership of buildings, and then to make a comparative analysis of the relevant legal provisions in respect of exclusive and shared parts of the country, This paper compares what is suitable to draw lessons from the division of proprietary part and common part of building in our country. Finally, which aspects should we start with in view of the division of proprietary part and common part of building in our country? The main purpose of which is to solve the practical problems existing in the division of ownership of architecture in our country.
