【摘要】：失獨(dú)老人意定監(jiān)護(hù)合同是失獨(dú)老人為防止其行為能力發(fā)生障礙或喪失,致使無(wú)法處理自身事務(wù)而預(yù)先訂立的一種授予代理人處理本人人身及財(cái)產(chǎn)等事務(wù)權(quán)利的合同。我國(guó)現(xiàn)行法域尚未規(guī)定失獨(dú)老人意定監(jiān)護(hù)合同的法律適用,在人權(quán)理念沖擊下,無(wú)法契合高齡化社會(huì)的需求。意定監(jiān)護(hù)合同應(yīng)遵照合同自由原則,以當(dāng)事人意思決定為基準(zhǔn),設(shè)定監(jiān)護(hù)人及其監(jiān)護(hù)責(zé)任范圍,并由相關(guān)機(jī)關(guān)給予公證及監(jiān)督,實(shí)現(xiàn)對(duì)失能的失獨(dú)老人進(jìn)行權(quán)益保護(hù)。
[Abstract]:The contract of guardianship is a contract made in advance to grant the agent the right to deal with personal and property affairs in order to prevent the obstacle or loss of his or her ability to deal with his or her own affairs. China's current jurisdiction has not yet stipulated the legal application of guardianship contract for the elderly who have lost independence. Under the impact of the concept of human rights, it is impossible to meet the needs of the aging society. According to the principle of freedom of contract, the intended guardianship contract should set the scope of guardianship and its guardianship responsibility on the basis of the parties' will decision, and the relevant organs shall give notarization and supervision to realize the protection of the rights and interests of the disabled independent elderly.
