【摘要】：谷歌數(shù)字圖書(shū)館計(jì)劃自發(fā)布之日起,就引來(lái)無(wú)數(shù)關(guān)注和期待。但其建設(shè)之路可謂命途多舛,風(fēng)雨兼程。經(jīng)過(guò)12年磨礪和發(fā)展,它終將迎來(lái)了涅湞重生的蛻變,讓理想照進(jìn)現(xiàn)實(shí)。2015年10月16日,Google Library終審落下帷幕,美國(guó)最高法院裁定谷歌圖書(shū)掃描項(xiàng)目合法系正當(dāng)使用,這是Google Library發(fā)展歷程中的重大轉(zhuǎn)折,也為長(zhǎng)達(dá)10年的版權(quán)之爭(zhēng)畫(huà)上了休止符。本文以合法判決為契機(jī),對(duì)其兩輪庭審展開(kāi)判例研究,探索Google Library對(duì)于我國(guó)數(shù)字圖書(shū)館建設(shè)的理論指導(dǎo)和借鑒意義。
[Abstract]:Google Digital Library program since the date of release, attracted countless attention and expectations. But its construction road can be described as many ill-fated, wind and rain. After 12 years of sharpening and development, it will usher in the transformation of the rebirth of Nezhen and bring the ideal into reality. On October 16, 2015, when the, Google Library finally came to an end, the United States Supreme Court ruled that Google's book scanning project was lawfully used. This is a major turning point in the development of Google Library, but also for the 10-year long copyright controversy on the rest. Taking the legal judgment as the turning point, this paper makes a case study on its two rounds of trial, and explores the theoretical guidance and reference significance of Google Library for the construction of digital library in China.
