【摘要】：生物科技的發(fā)展,帶來了人類生活的巨大變革,遺傳資源的價值越來越得到肯定,國內(nèi)的遺傳資源也逐漸進入了法律保護的視野。我國基于廣闊的疆域、獨特的生態(tài)環(huán)境以及人類活動的長久歷史,享有得天獨厚的遺傳資源。隨著遺傳資源的不斷開發(fā)利用,我國遺傳資源保護工作中的種種不足逐漸凸顯出來,遺傳資源流失現(xiàn)象多發(fā),生物剽竊行為層出不窮。在這一背景下,本文對我國遺傳資源的專利法律制度保護問題進行研究分析。論文第一部分首先集中論述遺傳資源及其相關(guān)概念的基本內(nèi)涵,分析其定義,了解其內(nèi)容,對遺傳資源的準確界定的同時說明遺傳資源保護的重要意義。其次對遺傳資源保護與管理的現(xiàn)狀進行介紹與分析,最后提出遺傳資源專利法律制度保護的必要性與可行性,論證遺傳資源專利制度保護的優(yōu)越性。論文第二部分指出遺傳資源專利法律制度保護中存在的問題,從專利法對“生物剽竊”行為的規(guī)定缺失、與生物多樣性公約對接不完善、遺傳資源專利法律制度保護配套法律法規(guī)與措施不夠完善這三個角度分析現(xiàn)行遺傳資源專利法律制度保護的不足之處。論文第三部分,針對第二部分已經(jīng)發(fā)現(xiàn)的問題提出對應(yīng)的解決措施。主要措施為完善與專利法律制度配套的其他法規(guī),加快遺傳資源數(shù)據(jù)庫的采集整理工作,最后要做好遺傳資源專利法律制度保護的宣傳工作。
[Abstract]:The development of biotechnology has brought great changes in human life, the value of genetic resources has been more and more affirmed, and the domestic genetic resources have gradually entered the field of legal protection. Based on its vast territory, unique ecological environment and long history of human activities, China enjoys unique genetic resources. With the continuous development and utilization of genetic resources, the deficiencies in the protection of genetic resources in China are gradually highlighted, the phenomenon of loss of genetic resources is frequent, and the behavior of biological plagiarism is emerging in endlessly. Under this background, this paper studies and analyzes the patent legal system protection of genetic resources in China. The first part of the thesis focuses on the basic connotation of genetic resources and related concepts, analyzes their definitions, understands their contents, and explains the importance of genetic resources protection while defining genetic resources accurately. Secondly, this paper introduces and analyzes the current situation of the protection and management of genetic resources, and finally puts forward the necessity and feasibility of the legal protection of the patent system of genetic resources, and demonstrates the superiority of the patent system protection of genetic resources. The second part of the thesis points out the existing problems in the protection of the patent legal system of genetic resources, from the absence of the provisions of the patent law on the act of "biological plagiarism", and the docking with the Convention on Biological Diversity is not perfect. The shortcomings of the current patent legal system of genetic resources are analyzed from the three angles of incomplete laws, regulations and measures for the protection of patent legal system of genetic resources. In the third part of the paper, the corresponding solutions are put forward for the problems found in the second part. The main measures are to perfect other laws and regulations supporting patent legal system, to speed up the collection and arrangement of genetic resources database, and finally to do a good job in publicizing the protection of patent legal system of genetic resources.
