【摘要】：城鎮(zhèn)化進程中農(nóng)民土地財產(chǎn)權(quán)的實現(xiàn)問題突出,引起廣泛關(guān)注。處理好農(nóng)民的土地財產(chǎn)權(quán)益問題是農(nóng)民能否真正成為市民并順利融入城市的關(guān)鍵。要在深入分析農(nóng)民市民化進程中土地問題的基礎(chǔ)上,認清土地問題產(chǎn)生的根源是目前不合理的土地產(chǎn)權(quán)及其交易制度,通過深化農(nóng)村產(chǎn)權(quán)制度改革,解決土地產(chǎn)權(quán)不明晰和所有權(quán)主體虛置問題;完善土地承包經(jīng)營權(quán)流轉(zhuǎn)制度,讓農(nóng)民帶著土地利益進城;限制公權(quán)對農(nóng)民土地財產(chǎn)權(quán)的侵害,完善征地補償制度;有效處置農(nóng)村閑置宅基地,釋放土地資源,促進農(nóng)民土地財產(chǎn)權(quán)的實現(xiàn)。
[Abstract]:In the process of urbanization, the realization of farmers' land property rights is prominent, causing widespread concern. How to deal with the land property rights and interests of farmers is the key to whether they can truly become citizens and integrate into the city smoothly. On the basis of deeply analyzing the land problem in the process of peasants' urbanization, we should recognize that the root of the land problem is the unreasonable land property right and its trading system, and deepen the reform of the rural property right system. To solve the problem of land property right is not clear and the subject of ownership is empty; Improve the circulation system of land contract management right, let farmers take the interests of land into the city, limit the infringement of public rights to farmers' land property rights, perfect the compensation system of land requisition; Effectively dispose of idle rural homestead, release land resources, and promote the realization of farmers' land property rights.
