【摘要】：高校職務(wù)發(fā)明活動相校于企業(yè)而言具有相對的獨立性,應(yīng)當(dāng)優(yōu)先體現(xiàn)我國職務(wù)發(fā)明制度從"集體本位"到"個人本位"的理念轉(zhuǎn)變。廣義的高校職務(wù)發(fā)明獎酬包括給予發(fā)明人及技術(shù)轉(zhuǎn)移人員兩類主體的經(jīng)濟(jì)報酬。我國《專利法》及其實施細(xì)則、《促進(jìn)科技成果轉(zhuǎn)化法》、《職務(wù)發(fā)明條例(草案)》等對于職務(wù)發(fā)明獎酬的規(guī)定可以適用于高校,需要在解決法律適用優(yōu)先次序、拓展獎酬涉及的職務(wù)發(fā)明范圍及提高獎酬標(biāo)準(zhǔn)等方面予以改進(jìn)。高校技術(shù)轉(zhuǎn)移服務(wù)人員的貢獻(xiàn)應(yīng)當(dāng)?shù)玫娇隙?并且賦予其獲得獎酬的法定權(quán)利,從而對其給予有效的激勵。
[Abstract]:There is relative independence in the activities of job invention in colleges and universities, so we should give priority to the transformation of the concept of "collective standard" to "individual standard" in the system of job invention in our country. The broad sense of college job inventor award includes two kinds of economic reward to inventor and technology transfer personnel. The Patent Law of China and its implementing rules, the Law on the Promotion of Scientific and technological achievements, the regulations on Job Invention (draft), etc., which can be applied to colleges and universities, need to give priority to the application of the law. Expand the scope of job invention and improve the standard of reward. The contribution of technical transfer service personnel in colleges and universities should be recognized, and the legal right to receive awards and remuneration should be given to them, thus giving them effective incentives.
