論不動產(chǎn)登記機關(guān)登記錯誤的賠償責任

【摘要】: 不動產(chǎn)登記為不動產(chǎn)物權(quán)交易提供具有國家公信力支持的、統(tǒng)一的、公開的法律基礎(chǔ),因此登記內(nèi)容正確與否關(guān)系重大,不僅影響到交易當事人的權(quán)益,也影響到不動產(chǎn)交易的安全與秩序。在實踐中,造成不動產(chǎn)登記錯誤的原因主要是我國不動產(chǎn)登記制度本身的缺陷和登記機關(guān)工作人員工作疏忽以及登記申請人的過錯。登記內(nèi)容發(fā)生錯誤,會給相關(guān)權(quán)利人造成損失,損失的數(shù)額往往十分巨大。因此要從源頭上減少錯誤登記的發(fā)生,提高登記人員素質(zhì),建立登記員資格考試制度。加強不動產(chǎn)登記錯誤的法律救濟,是完善我國不動產(chǎn)登記制度的重要內(nèi)容和目標。我國《物權(quán)法》規(guī)定了異議登記、更正登記以及登記機關(guān)的賠償責任等法律救濟制度,但相關(guān)法律條文對該賠償責任的性質(zhì)、歸責原則、賠償標準等重要問題規(guī)定得過于模糊、籠統(tǒng),對賠償?shù)慕?jīng)費問題沒有提及,導致相關(guān)法律條文在司法實踐當中缺乏可操作性,也在理論界引起了較大的爭議。 不動產(chǎn)登記行為本質(zhì)上是一種民事行為,而非行政行為。不動產(chǎn)登記機關(guān)登記錯誤的賠償責任應當屬于民事侵權(quán)賠償責任,適用過錯責任原則,當事人可以直接提起民事訴訟進行救濟,不動產(chǎn)登記機關(guān)的賠償范圍應以實際損失為準,這樣有利于最大化保護受害人的合法權(quán)益?梢苑e極借鑒國外相關(guān)立法經(jīng)驗,通過從登記費用中提取一定比例的費用、國家撥付一部分經(jīng)費以及不動產(chǎn)登記機關(guān)行使追償權(quán)所得款項來設立專項不動產(chǎn)賠償基金,并引入保險機制,保障不動產(chǎn)登記機關(guān)充足的賠償經(jīng)費,以完善不動產(chǎn)錯誤登記的賠償機制,最大化保護公民的合法財產(chǎn)。
[Abstract]:Real estate registration provides a unified, open legal basis for real estate transactions supported by the public credibility of the state. Therefore, whether the registration content is correct or not is of great importance, which not only affects the rights and interests of the parties to the transaction, It also affects the security and order of real estate transactions. In practice, the main causes of real estate registration errors are the defects of the real estate registration system itself, the negligence of the staff of the registration authority and the fault of the registration applicant. Registration errors will cause losses to the relevant rights holders, the amount of loss is often very huge. Therefore, it is necessary to reduce the occurrence of false registration from the source, improve the quality of registrants, and establish the examination system for the qualifications of registrants. It is the important content and goal to perfect the real estate registration system to strengthen the legal remedy of the real estate registration errors. The Law on Real Rights of our country provides for legal relief systems such as dissent registration, registration correction and the liability of the registration organ. However, the relevant provisions of the law are too vague on such important issues as the nature of the liability, the principle of liability imputation, the standard of compensation, and so on. In general, the expense of compensation is not mentioned, which leads to the lack of maneuverability of the relevant legal provisions in the judicial practice, and has caused a great controversy in the theoretical circle. The registration of real estate is essentially a civil act, not an administrative act. The liability for compensation for the registration errors of the real estate registration authority shall belong to the liability for civil tort compensation, and the principle of fault liability shall apply, and the parties may directly initiate civil proceedings for relief, and the compensation scope of the real estate registration authority shall be based on the actual loss, This is conducive to maximizing the protection of the victim's legitimate rights and interests. We can actively learn from the relevant foreign legislative experience, set up a special real estate compensation fund by drawing a certain proportion of the expenses from the registration fees, allocating some funds from the state and the income from the exercise of the right of recourse by the real estate registration authorities. In order to improve the compensation mechanism of false registration of real estate and maximize the protection of citizens' legitimate property, the insurance mechanism is introduced to ensure the sufficient compensation funds of real estate registration authorities.
