【摘要】：中央電視臺投入巨資拍攝的"春節(jié)聯(lián)歡晚會"在著作權(quán)法下的性質(zhì)在法律界飽受爭議,圍繞春晚的作品性質(zhì),各方學(xué)者和法官分別形成了"影視作品說""匯編作品說"和"錄像制品說"。春晚作品性質(zhì)爭議的根源主要在于對其節(jié)目獨創(chuàng)性的不同理解,通過對影視節(jié)目創(chuàng)作因素和表現(xiàn)形式的剖析,得出影視作品的獨創(chuàng)性主要通過"鏡頭"和"銜接"體現(xiàn)出來的結(jié)論,并將其歸納為影視作品獨創(chuàng)性的"鏡頭、銜接二維分析法"。以春晚典型案例的獨創(chuàng)性分析,明證春晚作為一部經(jīng)典的電視綜藝節(jié)目體現(xiàn)了較高的獨創(chuàng)性,可以在現(xiàn)行著作權(quán)法下被定性為影視作品。
[Abstract]:The nature of the "Spring Festival Gala", which CCTV has invested a great deal of money to film, has been controversial in the legal profession. It revolves around the nature of the works of the Spring Festival Gala. Scholars and judges formed the theory of film and television works, the theory of compilation works and the theory of video products respectively. The origin of the controversy about the nature of Spring Festival Gala's works mainly lies in its different understanding of the originality of its programs, and through the analysis of the factors and the forms of expression of the film and television programs. The author draws the conclusion that the originality of film and television works is mainly reflected by "lens" and "cohesion", and concludes it as "lens, two dimensional cohesive analysis" of original film and television works. Based on the analysis of the originality of the typical cases of Spring Festival Gala, it is clear that the Spring Festival Gala as a classic TV variety show embodies higher originality and can be characterized as a film and television work under the current copyright law.
