論網(wǎng)上銀行消費者權(quán)益的法律保護

【摘要】:網(wǎng)上銀行在方便人們?nèi)粘I畹耐瑫r,也帶來了消費方式與消費結(jié)構(gòu)上的重大轉(zhuǎn)變。另一方面,由于我國在網(wǎng)上銀行的管理和規(guī)制方面尚未形成成熟的制度,網(wǎng)上銀行消費者權(quán)益受侵害的現(xiàn)象時有發(fā)生。因此,分析網(wǎng)上銀行消費者權(quán)益保護實踐中存在的問題,針對網(wǎng)銀的特點構(gòu)建適當(dāng)?shù)南M者保護機制具有非常重要的現(xiàn)實意義。筆者運用實證分析法、文獻(xiàn)分析法等方法對我國網(wǎng)上銀行的消費者權(quán)益保護問題展開研究。全文除引言和結(jié)語外,共分為四個部分。第一部分為案例介紹。筆者選取了三個具有典型代表意義的案例,即網(wǎng)銀資金被盜取、網(wǎng)銀消費者個人信息遭泄露、網(wǎng)上銀行糾紛維權(quán)難事件。這三個案例引發(fā)筆者對網(wǎng)上銀行消費者權(quán)益保護問題的思考,并引出下文。第二部分分析我國網(wǎng)上銀行消費者保護存在的問題。結(jié)合上述典型案例及我國相關(guān)法律規(guī)定,可以看出,我國網(wǎng)上銀行消費者權(quán)益保護存在如下問題:銀行格式條款規(guī)制的缺失,信息披露制度不健全;糾紛解決機制不完善;銀行安全保障義務(wù)未履行;消費者個人信息泄露現(xiàn)象嚴(yán)重。第三部分論述網(wǎng)上銀行消費者權(quán)益保護的境外立法經(jīng)驗。筆者著重分析了美國和歐盟這兩個網(wǎng)銀監(jiān)管制度比較發(fā)達(dá)的國家和地區(qū)對網(wǎng)上銀行消費者保護法律機制的構(gòu)建。美國《公平信用報告法》對銀行獲取消費者個人信息的行為從條件、內(nèi)容、必要性、程序等方面都進行了限制和規(guī)范;歐盟《關(guān)于消費者合同中不公平條件的指令》對網(wǎng)上銀行格式合同中的不公平條款進行了明確的列舉。這些境外立法經(jīng)驗對我國網(wǎng)上銀行的立法管制提供了有益的借鑒。第四部分提出完善我國網(wǎng)上銀行消費者權(quán)益保護機制的對策建議。具體包括:規(guī)制網(wǎng)上銀行格式條款;健全信息披露制度;完善糾紛解決機制;嚴(yán)格銀行安全保障義務(wù);保護消費者個人信息;確立先予賠付機制。
[Abstract]:Internet banking not only facilitates people's daily life, but also brings about great changes in consumption pattern and consumption structure. On the other hand, because our country has not formed a mature system in the management and regulation of online banking, the phenomenon of consumers' rights and interests of online banks is infringed from time to time. Therefore, it is of great practical significance to analyze the problems existing in the practice of consumer rights and interests protection in online banking, and to construct an appropriate consumer protection mechanism according to the characteristics of online banking. By means of empirical analysis and literature analysis, the author studies the protection of consumers' rights and interests of online banks in China. In addition to the introduction and conclusion, the full text is divided into four parts. The first part is a case study. The author selects three typical cases, that is, the theft of online bank funds, the leakage of personal information of consumers, and the difficulty of defending rights in online banking disputes. These three cases lead the author to think about the protection of consumer rights and interests of online banking, and lead to the following. The second part analyzes the problems existing in consumer protection of online banking in China. In combination with the above typical cases and the relevant laws and regulations of our country, we can see that the following problems exist in the protection of consumers' rights and interests in China's online banking: the lack of regulation of bank format clauses, the imperfection of information disclosure system, the imperfect dispute resolution mechanism; Bank security obligations have not been fulfilled; consumer personal information leakage phenomenon is serious. The third part discusses the overseas legislative experience of online banking consumer rights and interests protection. The author emphatically analyzes the construction of the legal mechanism of consumer protection of online banking in the two developed countries and regions of the United States and the European Union. The Fair Credit reporting Act of the United States has restricted and regulated the behavior of banks in obtaining consumer personal information in terms of conditions, contents, necessity, procedures, etc. The EU Directive on unfair conditions in Consumer contracts clearly enumerates the unfair clauses in online banking format contracts. These overseas legislative experiences provide useful reference for the legislative regulation of online banking in China. The fourth part puts forward the countermeasures and suggestions to perfect the protection mechanism of consumer's rights and interests of online banking in our country. Specific include: regulation of online banking format clauses; perfect information disclosure system; perfect dispute resolution mechanism; strict bank security obligations; protect consumer personal information; establish prepayment mechanism.
