【摘要】：《民法總則》第127條將網(wǎng)絡(luò)虛擬財(cái)產(chǎn)規(guī)定為民事權(quán)利客體,盡管并未明確將其規(guī)定為物權(quán)客體,但是,從《民法總則》起草過(guò)程中的條文文本演進(jìn)以及從邏輯推理上,都可以看出立法實(shí)際上是肯定網(wǎng)絡(luò)虛擬財(cái)產(chǎn)是物權(quán)客體的,確認(rèn)網(wǎng)絡(luò)虛擬財(cái)產(chǎn)是網(wǎng)絡(luò)時(shí)代的虛擬物,可以建立所有權(quán)。《民法總則》這樣規(guī)定網(wǎng)絡(luò)虛擬財(cái)產(chǎn),增加了物權(quán)客體即物的種類(lèi),為網(wǎng)絡(luò)企業(yè)和網(wǎng)絡(luò)用戶的虛擬財(cái)產(chǎn)提供物權(quán)保障,為網(wǎng)絡(luò)交易平臺(tái)服務(wù)法律關(guān)系提供物質(zhì)基礎(chǔ)的法律保障,同時(shí)也為網(wǎng)絡(luò)虛擬財(cái)產(chǎn)的繼承提供了法律保障,因而具有重要的社會(huì)價(jià)值。
[Abstract]:Article 127 of the General principles of Civil Law defines the virtual property of the network as the object of civil rights, although it is not explicitly defined as the object of real right, it evolves from the text of the article in the drafting process of the General principles of Civil Law and from the logical reasoning. It can be seen that the legislation actually affirms that the network virtual property is the object of real right, and confirms that the network virtual property is a virtual thing in the network age, and can establish the ownership right. The General principles of the Civil Law stipulate the network virtual property in this way. It increases the category of the object of real right, provides the real right protection for the virtual property of the network enterprise and the network user, and provides the legal protection of the material foundation for the legal relationship of the network transaction platform. At the same time, it also provides legal protection for the inheritance of network virtual property, so it has important social value.
