【摘要】：協(xié)同創(chuàng)新是中國創(chuàng)新體系的重要組成部分,既要求產(chǎn)學(xué)研聯(lián)盟各主體深度合作和資源共享,也增加了知識產(chǎn)權(quán)的權(quán)屬糾紛和開發(fā)風(fēng)險,其中知識產(chǎn)權(quán)利益分配沖突是合作各方關(guān)注的焦點(diǎn),構(gòu)建科學(xué)合理的利益分享法律制度是產(chǎn)學(xué)研合作聯(lián)盟長期穩(wěn)定發(fā)展的基礎(chǔ),英國校企間合作的《蘭伯特協(xié)議范本》為我國提供了示范和借鑒。我國需要建立以獨(dú)有知識產(chǎn)權(quán)為中心、權(quán)利合理運(yùn)用和分享的法律制度,以平衡大學(xué)和企業(yè)對知識產(chǎn)權(quán)成果擁有和運(yùn)用的權(quán)利并保障產(chǎn)學(xué)研聯(lián)盟各主體的利益平衡和合作共贏。
[Abstract]:Collaborative innovation is an important part of China's innovation system. It not only requires deep cooperation and resource sharing among the subjects of the industry, education and research alliance, but also increases the disputes over the ownership of intellectual property and the risks of development. Among them, the conflict of the distribution of intellectual property rights is the focus of all parties concerned, and the establishment of a scientific and reasonable legal system of benefit-sharing is the basis for the long-term and stable development of the industry-university-research cooperative alliance. The Model Lambert Agreement on Cooperation between British Schools and Enterprises provides a model and reference for our country. China needs to establish a legal system centered on unique intellectual property rights with rational use and sharing of rights in order to balance the rights owned and used by universities and enterprises in intellectual property and to ensure the balance of interests and win-win cooperation among the main bodies of the industry-university-research alliance.
