民法典編纂視野下勞務(wù)派遣單位侵權(quán)責(zé)任研究

【摘要】:民法典編纂時(shí),勞務(wù)派遣單位侵權(quán)責(zé)任應(yīng)當(dāng)以控制因素為判斷標(biāo)準(zhǔn),主要是對(duì)勞動(dòng)者在勞動(dòng)過程中勞動(dòng)行為的控制,包括管理和監(jiān)督。如果勞務(wù)派遣單位控制著勞動(dòng)者的勞動(dòng)行為,那么勞務(wù)派遣單位應(yīng)當(dāng)承擔(dān)雇主替代責(zé)任,用工單位無需承擔(dān)侵權(quán)責(zé)任。如果勞務(wù)派遣單位沒有控制勞動(dòng)者勞動(dòng)行為,而是用工單位控制勞動(dòng)者行為,那么由用工單位承擔(dān)侵權(quán)責(zé)任,派遣單位無需承擔(dān)補(bǔ)充責(zé)任;派遣單位對(duì)選任有過失,需對(duì)用工單位承擔(dān)相應(yīng)的侵權(quán)責(zé)任。
[Abstract]:When the Civil Code is compiled, the tort liability of labor dispatch units should be judged by the control factors, mainly the control of laborer's labor behavior in the process of labor, including management and supervision. If the labor dispatch unit controls the laborer's labor behavior, then the labor dispatch unit should bear the employer's substitution liability, and the employment unit does not have to bear the tort liability. If the labor dispatch unit does not control the laborer's labor behavior, but the employment unit controls the laborer's behavior, then the employing unit bears the tort liability, and the dispatch unit does not have to bear the supplementary responsibility; The dispatching unit should bear the corresponding tort liability to the employer if it is negligent in the selection.
