【摘要】：轉(zhuǎn)換性使用是美國著作權(quán)開放式合理使用模式中的主導(dǎo)性標(biāo)準(zhǔn),也是我國專家學(xué)者衡量新型使用爭(zhēng)議的重要理論依據(jù)。但轉(zhuǎn)換性使用在內(nèi)容和目的上均存在解釋困境。對(duì)于"不同目的"和"新的表達(dá)、含義或信息"的界定缺乏客觀衡量標(biāo)準(zhǔn)。美國轉(zhuǎn)換性使用的普遍適用是后續(xù)法院遵循其最高法院判例的需求所致。轉(zhuǎn)換性使用更多的是法院判決結(jié)果合理化的說理帽子,而不是影響判決結(jié)果的分析工具。我國不應(yīng)過于注重對(duì)轉(zhuǎn)換性概念本身的界定,應(yīng)直接衡量使用背后所帶來的公共利益、交易障礙及對(duì)原著作權(quán)人創(chuàng)作激勵(lì)的市場(chǎng)影響,以達(dá)到社會(huì)科學(xué)文化的最大化發(fā)展。
[Abstract]:Transformational use is the dominant standard in the open and rational use of copyright in the United States, and it is also an important theoretical basis for Chinese experts and scholars to measure the new use dispute. However, the transformative use of the content and purpose of the interpretation of the dilemma. The definition of "different purpose" and "new expression, meaning or information" lacks objective measure. The universal application of transformational use in the United States is the result of the need for subsequent courts to follow their Supreme Court jurisprudence. The transformative use is more the reasoning hat of the court judgment result rationalization than the analysis tool which affects the judgment result. Our country should not pay too much attention to the definition of the concept of conversion, but should directly measure the public interests, trade barriers and the market impact on the original copyright owners' creation incentives brought by the use of the original copyright, so as to maximize the development of social science culture.
