【摘要】：作品冒名行為是比較常見的侵權行為。我國《著作權法》等多部法律法規(guī)對作品冒名行為分別予以規(guī)制,存在法律依據(jù)多頭、具體法條規(guī)定不一等問題。司法實踐中因選取的法律依據(jù)不同,致使同類案件的判決存在較大差異,同案不同判,危及了法律的權威,損害了司法的公正。為此,建議改進我國現(xiàn)行由《著作權法》《民法通則》《反不正當競爭法》等同時規(guī)制作品冒名行為的做法,明確作品冒名行為統(tǒng)一由《著作權法》規(guī)制,修改署名權以及作品冒名行為侵權責任等相關規(guī)定。
[Abstract]:The act of impersonating a work is a relatively common tort. Many laws and regulations, such as copyright Law of China, regulate the impersonation of works separately, there are many legal bases and different provisions in specific laws and regulations. Because of the different legal basis in judicial practice, there are great differences in the judgment of the similar cases. Different judgments in the same case endanger the authority of the law and impair the justice of the judicature. Therefore, it is suggested to improve the existing practices of regulating the impersonation of works by "copyright Law", "General principles of Civil Law", "Anti-unfair Competition Law" and so on, and to make it clear that the act of impersonation of works is regulated by "copyright Law". Modification of the right of authorship and work impersonation tort liability and other relevant provisions.
