【摘要】：2017年3月15日十二屆全國(guó)人大五次會(huì)議審議通過(guò)了《民法總則》,標(biāo)志著新中國(guó)民法編纂完成了第一步。文章介紹了前四次民法典編撰的歷史過(guò)程,并在其基礎(chǔ)上對(duì)《民法總則》做了宏觀評(píng)述,指出了《民法總則》在結(jié)構(gòu)體例、主要內(nèi)容等方面精準(zhǔn)地繼受了《民法通則》的做法,當(dāng)然也在自然人、法人、民事權(quán)利、訴訟時(shí)效等方面有所創(chuàng)新。同時(shí)也指出了《民法總則》無(wú)論是在民事權(quán)利的具體內(nèi)容方面還是在立法技術(shù)等方面的創(chuàng)新還不夠,還需要進(jìn)一步的完善。
[Abstract]:On March 15, 2017, the Fifth session of the 12th National people's Congress deliberated and adopted the General principles of Civil Law, marking the completion of the first step in the compilation of civil law in New China. This paper introduces the historical process of compiling the first four civil codes, makes a macroscopic comment on the General principles of Civil Law on the basis of them, and points out that the General principles of Civil Law have been precisely followed by the General principles of Civil Law in the aspects of structure and main contents. Of course, in natural persons, legal persons, civil rights, statute of limitations and other aspects of innovation. At the same time, it also points out that the general principles of civil law are not enough in the specific content of civil rights or in the legislative technology, and need to be further improved.
