論建筑物區(qū)分所有權(quán)剝奪

【摘要】:建筑物區(qū)分所有權(quán)的剝奪,其本質(zhì)上就是將業(yè)主從建筑物區(qū)分所有權(quán)共同體關(guān)系中予以驅(qū)逐,為建筑物區(qū)分所有權(quán)法上的一項(xiàng)特殊制度,是一種懲罰和救濟(jì)制度。這一制度的設(shè)立能很好的應(yīng)對日益增加的業(yè)主破壞建筑物區(qū)分所有關(guān)系或危及區(qū)分所有建筑物存續(xù)的行為,對區(qū)分所有建筑物的管理有著重大和積極的意義。建筑物區(qū)分所有權(quán)剝奪制度在中國沒有入法,本文以我國應(yīng)該建立建筑物區(qū)分所有權(quán)剝奪制度為出發(fā)點(diǎn),首先對建筑物區(qū)分所有權(quán)剝奪的內(nèi)涵和理論框架進(jìn)行梳理,介紹業(yè)主成員權(quán)和區(qū)分所有建筑物之管理等相關(guān)概念。其次,通過對外國建筑物區(qū)分所有權(quán)剝奪制度的立法模式的比較,分析對我國制度設(shè)立的借鑒意義。最后,本文對建筑物區(qū)分所有權(quán)剝奪制度的具體法律制度設(shè)立提出一些構(gòu)想。本文對設(shè)立建筑物區(qū)分所有權(quán)剝奪制度的國家的制度進(jìn)行比較研究,認(rèn)為我國應(yīng)該建立如同德國和日本的建筑物區(qū)分所有權(quán)剝奪制度。同時(shí)總結(jié)出了對我國制度建立的借鑒方面:首先,要具體化剝奪建筑物區(qū)分所有權(quán)的具體情形。其次,要對剝奪區(qū)分所有權(quán)制度的程序加以規(guī)定。此外,要對剝奪方式方法有正確的把握,既要維護(hù)其他區(qū)分所有權(quán)人的權(quán)益,也要注意防止剝奪制度的濫用。我國《物權(quán)法》第八十三條是業(yè)主應(yīng)當(dāng)遵守法律、法規(guī)以及管理規(guī)約,對違反法律、法規(guī)和管理規(guī)約的行為規(guī)定了停止侵害、消除危險(xiǎn)、排除妨害、賠償損失的救濟(jì)措施。建筑物區(qū)分所有權(quán)剝奪制度是一種針對嚴(yán)重違反業(yè)主義務(wù)行為的懲罰措施,故應(yīng)規(guī)定在業(yè)主義務(wù)法條之后,建議規(guī)定在八十三條之后專條敘述。建筑物區(qū)分所有權(quán)剝奪制度是一種民事制裁、懲罰措施。鑒于此制度甚為嚴(yán)厲,如果規(guī)定模糊,勢必會造成此制度的亂用或無法適用,所以本文將從制度可行性、責(zé)任主體、歸責(zé)原則和具體法律設(shè)計(jì)來詳細(xì)論述區(qū)分所有權(quán)剝奪制度。同時(shí)對建筑物區(qū)分所有權(quán)剝奪制度的具體法條設(shè)置進(jìn)行大膽的建議。
[Abstract]:The deprivation of building ownership is essentially to expel the owner from the community relationship of building ownership, which is a special system in the law of building ownership, and is a punishment and relief system. The establishment of this system can deal with the increasing number of building owners breaking up the relationship between all buildings or endangering the existence of all buildings. It is of great and positive significance to the management of all buildings. The system of deprivation of building ownership has not entered the law in China. In this paper, we should establish the system of deprivation of ownership of building division as the starting point, first of all, to sort out the connotation and theoretical framework of the deprivation of building ownership. This paper introduces the concept of owner's membership right and management of all buildings. Secondly, by comparing the legislative models of the foreign building ownership deprivation system, the paper analyzes the significance of the establishment of the system in our country. Finally, this paper puts forward some ideas on the establishment of the specific legal system of building ownership deprivation system. This paper makes a comparative study on the system of building condominium deprivation system in our country, and holds that China should establish the system of building ownership deprivation system like that of Germany and Japan. At the same time, it summarizes the reference to the establishment of our system: first, the specific situation of deprivation of ownership of buildings. Secondly, the procedure of deprivation of differentiated ownership system should be stipulated. In addition, we should have a correct grasp of the ways and means of deprivation, not only to safeguard the rights and interests of other differentiated owners, but also to prevent the abuse of the deprivation system. Article 83 of our country's "Real right Law" is that the owner should abide by the laws, regulations and management rules, and stipulate the relief measures to stop the infringement, eliminate the danger, remove the obstruction and compensate for the loss. The system of deprivation of building ownership is a kind of punishment measure for serious breach of owner's obligation, so it should be stipulated after the owner's obligation law, and then it is suggested that it should be stated after 83 articles. The system of deprivation of building ownership is a kind of civil sanction and punishment measure. In view of this system is very strict, if the provisions are vague, it will inevitably lead to the misuse of the system or can not be applied, so this paper will discuss the system of differentiated ownership deprivation in detail from the feasibility of the system, the subject of responsibility, the principle of imputation and the specific legal design. At the same time, the specific provisions of the system of deprivation of ownership of buildings are proposed boldly.
