信用卡持卡人權(quán)益的民法保護(hù)

【摘要】:信用卡是近年來在我國(guó)應(yīng)用十分廣泛的一種支付工具。由于其具有可透支資金消費(fèi),安全便捷等優(yōu)點(diǎn),不僅豐富了人們的消費(fèi)方式,而且能夠刺激潛在的消費(fèi)需求,進(jìn)而促進(jìn)商品經(jīng)濟(jì)發(fā)展。所以越來越多的人開始選用信用卡這種支付方式。但是,信用卡同時(shí)還具有虛擬性、電子性等特點(diǎn),信用卡交易過程存在諸多風(fēng)險(xiǎn)。持卡人與信用卡法律關(guān)系中其他主體相比處于相對(duì)弱勢(shì)的地位,權(quán)益很容易受到侵害。從當(dāng)前各國(guó)的立法實(shí)踐看,均有出臺(tái)相關(guān)法律對(duì)持卡人的權(quán)益進(jìn)行特殊保護(hù)。鑒于此,本文圍繞信用卡持卡人權(quán)益保護(hù)問題,分四個(gè)部分進(jìn)行了論述,首先對(duì)信用卡的概念和基礎(chǔ)理論進(jìn)行簡(jiǎn)要的介紹,對(duì)信用卡主體之間既相對(duì)獨(dú)立又彼此牽連的法律關(guān)系有一個(gè)初步的了解,為下文的分析奠定基礎(chǔ)。其次,分別對(duì)持卡人知情權(quán)保護(hù)問題,信用卡盜刷案件中,持卡人資金安全保護(hù)問題以及信用卡消費(fèi)過程中,持卡人對(duì)于瑕疵商品或服務(wù)的抗辯權(quán)問題進(jìn)行探討。通過對(duì)近年來發(fā)生的經(jīng)典判例進(jìn)行總結(jié),分析我國(guó)的現(xiàn)行法律規(guī)定及司法實(shí)踐中對(duì)持卡人權(quán)益保護(hù)存在的不足,同時(shí)借鑒外國(guó)的相關(guān)立法經(jīng)驗(yàn)以及制度設(shè)計(jì)。通過對(duì)上述三個(gè)問題的探討,以期能夠從民法角度提出保護(hù)持卡人權(quán)益的可行性建議,保障信用卡行業(yè)的穩(wěn)定健康發(fā)展。
[Abstract]:Credit card is a kind of payment tool which is widely used in our country in recent years. Because of its advantages of overdraft fund consumption, safety and convenience, it not only enriches people's consumption mode, but also stimulates the potential consumption demand and promotes the development of commodity economy. As a result, more and more people are choosing credit cards as a form of payment. However, credit card also has the characteristics of fictitious, electronic and so on. There are many risks in the process of credit card transaction. Cardholders are in a relatively weak position compared with other subjects in credit card legal relations, and their rights and interests are vulnerable to infringement. From the current legislative practice in various countries, there are relevant laws to protect the rights and interests of cardholders. In view of this, this paper focuses on the protection of the rights and interests of credit card holders, which is divided into four parts. Firstly, the concept and basic theory of credit card are briefly introduced. There is a preliminary understanding of the legal relationship between credit card subjects, which is relatively independent and implicated with each other, which lays a foundation for the analysis below. Secondly, the paper discusses the protection of cardholder's right to know, the security of credit card holder's funds in the case of credit card theft, and the right to defend the defective goods or services in the process of credit card consumption. Through summing up the classical cases in recent years, this paper analyzes the current laws and regulations of our country and the deficiencies in the protection of the rights and interests of cardholders in judicial practice, and at the same time draws lessons from the relevant legislative experience of foreign countries and the design of the system. Through the discussion of the above three problems, the author hopes to put forward the feasible suggestions to protect the rights and interests of cardholders from the angle of civil law, and to ensure the steady and healthy development of the credit card industry.
