【摘要】：老年監(jiān)護(hù)設(shè)置不同于未成年人監(jiān)護(hù)設(shè)置,設(shè)置依據(jù)是老年監(jiān)護(hù)設(shè)置的前提條件,卻為學(xué)界所忽視。對(duì)監(jiān)護(hù)設(shè)置歷史的追溯可以發(fā)現(xiàn),監(jiān)護(hù)設(shè)置依據(jù)自古包括智能和體能兩因素,近現(xiàn)代國家民法中也多有體現(xiàn)。不同于未成年人體能和智能增長(zhǎng)"從無到有"的過程,老年人因衰老而導(dǎo)致的體能與智能減損是一個(gè)"從有到無"的過程,年齡無法成為設(shè)置老年監(jiān)護(hù)的直接依據(jù)。智能或體能減損致老年人無法"正�；�"生活是老年監(jiān)護(hù)設(shè)置的合理標(biāo)準(zhǔn)。
[Abstract]:The setting of elder guardianship is different from that of minors, and the basis of setting is the precondition of the setting of elder guardianship, which has been ignored by the academic circles. Tracing back to the history of guardianship setup, it can be found that the basis of guardianship setup includes two factors of intelligence and physical ability since ancient times, and it is also reflected in modern national civil law. Different from the process of "from nothing to existence" in the growth of minors' physical ability and intelligence, the physical and intellectual impairment caused by the aging of the elderly is a "from having to nothing" process, and age cannot be the direct basis for setting up the elderly monitoring. It is a reasonable standard for the elderly to be unable to "normalize" their life due to mental or physical impairment.
