【摘要】：盡管非財產(chǎn)損害的概念系從精神損害發(fā)源而來,二者間的混用亦十分常見;然隨著時代的發(fā)展,學界逐漸認識到財產(chǎn)損害以外的其他損害類型并非全然表現(xiàn)為精神損害。非財產(chǎn)層面的損害除精神痛苦外,亦包含死亡、殘疾等人身損害以及外部名譽損失等。學者區(qū)分意識的覺醒并非憑空杜撰,而是從侵權(quán)法律實踐之發(fā)展歸納而來。各國法上無法為精神損害所容納之其他非財產(chǎn)損害的出現(xiàn),促進了非財產(chǎn)損害與精神損害概念間的分離,而其種類的不斷豐富則推動非財產(chǎn)損害成為與財產(chǎn)損害并列之損害類型。
[Abstract]:Although the concept of non-property damage originated from mental damage, the mixed use of the two is very common; however, with the development of the times, scholars gradually realize that the other types of damage other than property damage are not completely manifested as mental damage. In addition to mental suffering, non-property damages include death, disability and loss of external reputation. The awakening of scholars'consciousness of discrimination is not a fiction, but a summary from the practice of tort law. The emergence of other non-property damage which cannot be accommodated by the law of various countries promotes the separation between the concept of non-property damage and moral damage. And the constant enrichment of its kind promotes the non-property damage to become the damage type parallel to the property damage.
